Hello,

I have been having problems in my marriage i was married to my wife 3 months ago in her country. I am US Citizen and she is abroad living in her country, I filled the i-130 for her 2 months ago and it is in process with Potomac Service center. Until i know for sure our issue can be resolved as it has gotten so bad I'm not sure if it will be resolved as i am suspected fraud on her side now. i would like to know if there is a way to pause the application from being approved. If not what options do i have?

I understand after the service center approves and send the NOA2, the case goes to NVC what is the process and length at this stage? Does the case get paused at NVC and they request further information? Will my wife get any notification regarding the case approval if NOA2 is sent?

Please advise.

The NOA2 will only be sent to you in the mail, not to her. The only way she would know about the NOA2 is if she knows your petition receipt number and knows how to look up the case status online.

You can pause your own process for as long as you want at the NVC stage, as long as you don't let a whole year go by without contacting NVC. If you end up working things out, you can continue the process by following the last instructions you got from NVC (you'll get a welcome letter from them after USCIS sends them your I-130, so after that letter, you can choose not to follow their instructions...which pauses your process). If your relationship falls apart, you can either let more than a year go by without contacting NVC and they'll close your case, or you can mail NVC a letter requesting withdrawal of your application.

After NOA2 case is sent to NVC, will NVC send a letter only to me right? I read somewhere they also send a package to the person you are petitioning is this correct?

Also if things fall apart and get separated and i get married again to someone else i cannot file another i-130 until NVC application is cancelled?

Seems like you've made up your mind about getting separated and not patching things up. If so, you can withdraw the petition from USCIS before they approve and send your case to NVC. If USCIS send your case to NVC before your withdrawal request, you can still withdraw your case from NVC and don't need to wait for the whole year to get cancelled.

if you think the time might heal whatever misunderstandings or doubt/suspicion you have, you can let the process take its course and can leave the case at NVC for up to a year before getting cancelled.

In any case, you will need your divorce certificate/decree as a proof of termination of this marriage to file i-130 for your next spouse.

yes NVC will send you a letter and not to the beneficiary

if you don't feel like moving forward you have one year to think as you have one year to send them papers

cannot answer the other part but i guess if you want to cancel , just email nvc about it with your case number they will cancel the case

and then when you want to file another i-130 you can

If he were smart he wouldn't say a thing if he suspects fraud until he has proof, she'll only deny it. Let's face it, no one would admit fraud to his/her spouse if they are using them as a means to get to the US.

Of course not, but saying "hey I'm not happy right now..." and starting a communication line helps in a genuine relationship.

all true unless you supplied her email ID for her also to recieve notifications / my husband received notice of NOA2 and interview as I had given his email ID

if that is so, withdraw your petition fast or when it goes to NVC, do not supply the needed documents and let it die there

sooner or later you will have to withdraw the petition so it does not interfere with new application if you decide to make one

That seems a strange kind of thought for someone who is not even separated yet. And why would you need to file another I-130? If you marry locally you won't need to do any of this paperwork again. Or are you hoping to bring in another foreign spouse? Almost makes me think you have someone in mind already.

I'm just trying to be educated in the process. I am hoping we can work this out, she hasn't been very helpful so far. If things don't get back on track obviously i will get married again and i don't know if it will be local or overseas. I don't have anyone else in mind, i love this women and she doesn't even care to respond properly.
