Timeline

I make currently 33k a year. set to go up in the next couple of months to 35 k. I have 2 children with my EX and I raise my neice that gets social security death benifts that total $1100 monthly. So 2015 tax return I claimed only my niece because my ex claimed both of our children but our divorce decree states that I will only be claiming 1 child every year.

What I know.... with only my income I will not meet the 125% guildline set forth for 2016 if I have to claim my 2 children and my niece myself and fiance=5 in household. If I check partially support for my niece and 1 child will that make a diffrence I do own a home and with the housing market the estimated value vs my mortgage I am about 30k to the good. Should I be worried about this or am I freaking out for no reason?

Timeline

All minor children will be counted in your household, no matter where they live or who claims them on their taxes. So, since you claim your niece on your taxes, your household size will be 5. You meet the 100% but not the 125%. The CO will be the one to decide about your case. Add assets to make up for the $2k you are currently short, or get a joint sponsor. Your other option is to postpone the interview until you are earning the $35k you need to meet the 125%.
