Timeline

This will sound complicated so i will try to break it down.

I make $33k I have 2 kids and a neice that i raise. Recently divorced finalized in 2016.

Divorce states that EX claims 1 child every year. I can claim other child and neice =2 dependents on taxes starting 2016.

On part 5 of the i-864 affidavit of support it is asking for dependents. unsure of what I need to put because if i claim both of my kids and my neice my self and my soon to be husband I will not meet the income guidelines.

how ever there is supplemental income that comes into the household in the form of social security death beneifts to support my neice that totals $1100/month.

In short...part 5 of house hold size should i fill it out like this

1. 1-fiance

2. 1myself

3. 0

4. 1- child

5. 1- neice

Should i include my neices income in section 6? does that mean that i have to fill out another i-864 for her check 1.d. and submit her birth certicicate and thats it or do i have to fill out the whole form again?

No you claim BOTH your children regardless of where they live or if you support them or claim them on your taxes. They are your children, period.

If you claim your niece on your taxes as a dependent then you also have to put her down. However I'm unsure if you need an I-864a or not or if can even include the income to raise her. I would assume you can but how you would do this, I'm not sure. Hopefully someone else can be along to help you.
