Probably mistake from USCIS / Change nonimmigrant status denied

Nobody has a right to have their application for a change of status approved. Whether you agree with the decision or not, arguing with USCIS is not likely to change their decision, since the stated reason clearly applies to you -- no matter what the starting date was on your application or is now, it is obviously more than 30 days after the end of your B visa status, which you said was in February.

Your best chance to study in the US now is to listen to the USCIS orders that you need to depart the US immediately and then apply for a student visa in your home country. The longer you delay the inevitable, the more likely you are to have the visa denied -- as you will have demonstrated that you do not comply wih US immigration law by not following the USCIS instructions to depart.

Presumably there is a BF somewhere that would give you another option.

F1 Visa judging from the limited information here seems somewhat unlikely.

Sorry for taking this long to answer the messages. I was trying to reach the student services so I could come back with some explanations.


So, Arken was right and the student service has been updating my course's start day every month while my request wasn't processed. I just feel really frustrated, first because I applied at least 60 days before my expiration date and they took 120 days to process my request, so I don't feel that's my fault (the USCIS asks a 40-day term to process it). Second, because my school's student service didn't warn me about this possibility. Anyways, I decided to go back to my country and try again in the future.



-- Boiler, this is a preparation course for the TOEFL exam, therefore, I could start whenever I want and keep taking classes until I feel prepared to take the test.

Could you not take the class in Brazil?

Could you not take the class in Brazil?

I could but since my English is far from reasonable, I was looking for more intensive classes.

And it's completely different studying and living in an anglophone country from taking classes in Brazil, believe me =)
