GOD IS AMAZING!!!!!

I got to the embassy at around after 6am for a 7am interview. Got to the first window at almost 7:30 and presented the necessary documents (marriage certificate, police record, birth certificate and medical)

Waited almost an hour then name was called for the interview

I wasn't asked for any tax stuff or pictures. They did ask me quiet a few questions though

Questions asked

Who is filing for you?

What is her name?

Have you ever been arrested?

Has she ever been arrested?

Does she have any children?

What are their names?

How old are they?

Do you have any kids?

How long have you known your wife?

How long have you been married?

How old is your wife?

What does she do?

Who is (the name of affidavit of support)?

When last did you speak to your wife?

Is she nervous for you?

What did you talk about today?

How does your wife make money?

Have you discussed with her if you should get denied?

Okay you are approved

Hello everyone congrats Dwheels, so our interview went well today but we were put in AP and receive a 221 paper for a joint sponsor. My husband meets the requirements now with his current job but his 2015 tax transcript is showing different so joint sponsor it is. But all in all passports were kept and they asked us just to bring that and we will be good to go.

Oh I am so sorry. How long was the over stay? Was t more than 180 days? This is a work Visa correct?

My wife is a GC holder and she got her permanent residency through work. I was denied a US non immigrant visa two and a half years ago and the CO indicated that this (my wife filing for me after she got her PR) was the way for me to be approved. Overstay was more than 365 days, F-1 visa, no formal finding, I left on my own accord since we wanted to figure things out and start a family.

Can't plan for a question like that. I spoke honestly and stated that my wife and I would work through whatever obstacles and that we would do so together. I was abit surprised when that was asked but just speak honestly and from your heart.

If it's possibly a 10 year ban, it's at least one year of overstay. I say that's overly harsh and doesn't really fix anything, but I don't know what the answer to "fixing" that is =(

That's correct. If they deny it and I have a 10 year ban, there are couple of ways to go about it: wait 7 more years since I've been out of the US for close to 3 (which we're not doing) or apply for a waiver to the ban. I'm not sure how easy it is to get one of those approved but I do know they take 6 months to process. We would be getting a different lawyer if we have to attemp the waiver, our current one is hopeless. I'm trying to stay positive and so hope for an approval but I'm realizing it could go the other way very easily. It's definitely trying times for us, I can't even express the feeling, I've never felt like this in my entire life.

How to upload the delivery address on ustraveldocs.com?? I'm kinda confused! My passport name is LEE,SHU-YUAN, but when I tried to sign up, it showed errors. Do I omit the dash and comma in my name?! It said same as created on your passport...

That's correct. Obviously we were wrong, but I know that terrifying feeling, at least somewhat. Not on the 10 year level, but 3 years apart might as well be 10 in my eyes... We were all set to just move to Canada, or any place we could if Canada (for whatever reason) didn't want me coming in.

Most lawyers seem pretty clueless (amazingly so). Maybe immigration law is the easy way to just be a screw up and not really try very hard? I don't know. I hope you can get the waiver through if you need it, but hopefully you can get everything done without all of that. I wish I had some good advice on what to do or who to call =( I can only wish you the best at this point.

Thanks for the thoughts! Yea, they're fine with anything less than 180 days overstay for immigrant visas, they might ask about it but they can't deny the application. And the waiver is based on extreme hardship. So yep, here we are.

When I was getting my Australian Permanent Residency, the Case Office asked me "What would happen if you were denied?" My jaw dropped and I must have looked totally shocked. I mumbled something about trying another time or another way.

The CO smiled at me very apologetically and said that she was required to ask that question of everyone, and that she could tell, from the facial expression of the petitioner, how much the visa meant to them.

It's a good question to be prepared for!

Well, I'm in AP following my interview today. I have a previous overstay which is the reason. So they need some time to look into it and make the decision. It'll either be an approval or a denial with a 10 yr ban. I was told we'll hear from them in a few days. They did keep my passport and docs. Stressful time for us right now, as if it wasn't stressful enough to get to this point.

I'm sorry to hear about that. Keeping your passport is a good sign, really hope it all works out in the end.
