Timeline

Well, I'm in AP following my interview today. I have a previous overstay which is the reason. So they need some time to look into it and make the decision. It'll either be an approval or a denial with a 10 yr ban. I was told we'll hear from them in a few days. They did keep my passport and docs. Stressful time for us right now, as if it wasn't stressful enough to get to this point.

Now the case shows as ready! That was fast, wasn't it? I only recall seeing it ON TRANSIT yesterday...

Hey everybody sorry been absent through the weekend. Had to make the trip to families village to be with the In Laws and siblings to celebrate our 1 year wedding anniversary on Sunday. And to tell the news "WE ARE APPROVED".

That was hard for my husband to tell his momma that he is now moving to US at end of June.

I'm heading back to US after 6 months here on Friday.

So how is everybody. :goofy:

Hey everyone I wanted to get some advice please. We have been scheduled for an interview on June 27th in San Salvador and we're currently getting everything ready. However, when my wife called the doctors to schedule her medical appointment they all claim to be booked until after the interview date. What should we do? She called the embassy and they basically said we can either attend the interview without the medical or reschedule our interview date. I don't like either of those ideas!! haha

My advice is to keep the interview date and get your medical as soon as possible after that. You'll be given a 221 (missing info) document at the interview, and you will not be approved until they get the medical results. But you have waited so long for the interview that it's probably easier to get a doctor's appointment!

If you are close to the doctor's office, call them and have them let you know if there is a cancellation and you might be able to get squeezed in before the interview. Call the doctors twice a week to see if anything has opened up.

With that being said, has anyone heard of a denial after AP? I'm thinking them keeping my passport is good news, it sure beats being denied on the spot. Any advice or info is appreciated, I know I can't do much at this point.

Do not reschedule the interview just go and in the meantime keep calling the medical place. You would be put in AP until you get results to them. No issue. But DO NOT reschedule.

It's okay to make an address change at POE, right? Just asking cause hubby might get a new place and there's a chance the deal might not be finalized by the time of my interview.

So...first change of address at POE and then online?

Chargeability” refers to the rules which are used to determine under which country you will be counted for green card purposes.There are certain categories under which you can obtain a “green card” (i.e., U.S. Permanent Residency) which do not have any limit on the number of green cards that are issued each year. For example, “immediate relatives” of U.S. Citizens (i.e., spouses of U.S. citizens, parents of U.S. citizens, and unmarried children under 21 years of age) are not subject to numerical quotas.

However, most categories under which you can obtain a “green card” are only allocated a limited number of immigrant visas (“green cards”) each year, and there are country limits imposed as well (in order to prevent having all of the year’s green cards going to a few countries). For these types of categories, it is often important to determine under which country you will be counted because it could make a big difference in terms of how long you will have to wait for a green card. Normally, you are counted under the country in which you were born, subject to certain exceptions. The State Department explains these rules in general as follows:

Ordinarily an immigrant is chargeable for visa purposes to the numerical limitation for the foreign state or dependent area in which the immigrant's place of birth is located. Exceptions are provided for a child (unmarried and under 21 years of age) or spouse accompanying or following to join a principal to prevent the separation of family members, as well as for an applicant born in the U.S. or in a foreign state of which neither parent was a native or resident. Alternate chargeability is desirable when the visa cut-off date for the foreign state of a parent or spouse is more advantageous than that of the applicant's foreign state.

Oh I am so sorry. How long was the over stay? Was t more than 180 days? This is a work Visa correct?
