I goofed when starting K-1 visa application for my Chinese fiance. I did not state she visited Australia with her Chinese passport. Of course the interview process caught my mistake and required her to get a record check from Australia. The consulate suggested she contact a company near the consulate to get the record check for her. She told me today her passport is ready to be returned with the K-1 visa to come to the USA. However the company requests 20000 yuan before they will send her passport back to her. That is about $3200 dollars and that seems like a real scam. Am I right?

Sounds like a scam.

She visited? Police records are only required if a person lived in a country for more than 1 year. If it's the country of her nationality or current residence then 6 months.

Also, the below link states that you can obtain them via their website.

It would be nice if it was so simple! This other company recommended by the consulate somehow has her passport and visa and will not release it to her until she pays the money. My fiance is sleeping now and will wake up in about 5 hours. I hope all of this is a terrible mistake.

I so wish I had not tried to do all of this by myself and paid for help. I did not know about this site.

I don't like you say somehow have the passport???

Did she give her permission to the embassy to pass on the passport?

Otherwise that seems really weird? Have you contacted the embassy to see if the have it maybe?

Somehow? The consulate also wouldn't issue the visa until all their requests have been satisfied as in, without the police certificate from Australia.

How does the company have her passport with the K-1 visa issued? Did the company already do the record check? Something is off here...

Check her case status in the ceac tracker: https://ceac.state.gov/ceac/ and see if it says 'Issued'
