No because I wanted some advice first just in case. Because the lease agreement says that visitors staying more than 2 days must have a background check and file an application. I'm afraid once she hears "he's coming on a visa and has no record and you can't do a background check" she's going to immediately say no and my fiance has no where to go.

It sounds like that could be considered discrimination if she declines him based on him coming on a visa. Also, he had to have a police report during the visa process so you can offer that as a supplement.

In DR you need a clean record report for the interview not sure how it is in el salvador but if you do can you use that one??? Its a step that is taken right before the interview. If thats the case i would get two and submit to your landlord

Like Boiler said, the landlord does the reference checking. They can use and online application like Sterling Back Check as I often do in Canada for credit and criminal checks for candidates from around the world. (I work in HR) Good you are doing it the right way....better for sleeping at night . Back Check is international but can limit as well to just one country.

In my case, we just did a lease modification by adding me into the ease and paid $20 for my background check. Usually, it's up to the leasing office do the background check, you should submit anything to them

I am actually calling my landlord tomorrow about the exact same thing.

I was a little more worried about the credit check than the background check, since he won't have any credit. I am hoping that since my credit is fine and I have been paying my rent on time for 2 years it wont be too much of an issue..

Anyway I can let you know what my landlord says tomorrow? Obviously it's going to be different case by case but maybe it can give you insight on what to expect!

When my wife first arrived (K1), we weren't married yet but I was able to add her to the lease. My SSN was sufficient for the credit check, since she didn't have one yet. In regards to the background check, they knew she had just arrived to the US and just took a copy of her passport for ID. You'll need to talk to the landlord/leasing office.

We explained the situation to our leasing office and they let us wait until we had hubby's SSN. They did a lease modification and charged a small fee for the background check. I had been living there for several years beforehand and always paid on-time or early. I'm sure they have dealt with this before. Just ask ahead of time and see what they need and how you can work with them to do things properly. Unless they are just a jerk, they'll be appreciative of your communicating with them. If they have not had a situation like that, it gives them time to find out. You will be fine

We had a similar situation so I provided our landlord with a copy of my police clearance I had to get anyway for the K1. I didn't wait for him to ask for it, I offered it right away. It worked out.

I tried to add my husband to my lease for proof of relationship. They asked for credit check and all that, I told them that he does not have a ssn and the reason I wanted to put him on the lease. I just said put him on the lease as one of the person who lives here, like my children and I will be the only one responsible for the bill. They told me let them check into it and see what can be done for a situation like this. As of right now, I have not heard from them, but if I be late for my rent, they call and text me. Its good that he come here and live with me and I dont have to worry about anything else.

I'm not sure why you need to be nervous? The US is doing a whole bunch of background checking on him, so the apartment should be a breeze when the time comes. If you've been living in the apartment for a while without issue, his lack of credit shouldn't hurt anything. The form just asks for previous addresses, if convicted of crimes, stuff like that. Just fill it out as best you can. There obviously won't be any crimes on his record (I assume).

Landlords typically do, but how do they get a background check on someone just entering the USA on a k1 visa? He had no record of anything in the USA. Only his home country.

Then the US background check will come back as clean.

Talk to your landlord. Your case, obviously, is a little different. USCIS and the Embassy have just checked him left and right and issuing of the visa is proof that he has passed their muster, which would be more intense than the landlord.

If you want to provide one yourself, give the apartment complex a copy of the criminal backgroud check you have to provide to USCIS

The fact that someone's arriving on a K-1 visa means they have had to prove a clean record, right?
