I was wanting to file my I-129F this week, but now I have a question on the affidavit of support. I am a US citizen and Fiancee is from Philippines. I am in the process of moving and switching jobs. I am tentatively scheduled to move into new house on May 31. It is not possible to stay in the job I am in now as its too far to commute. I had been with the company I am leaving for over 12 years. I have a solid employment history and if you looked at my W-2's they would be very consistent for the last several years with a slight upward trend, last year I made about 80K.

I have a guaranteed job near the house I am moving to at a similar salary, but I was going to take 6-8 weeks off to take a break and get settled into new place. I was also going to visit fiancée again during this timeframe.

So if I file now, it is possible that I could be 'in between" jobs during interview process. Is this a problem or is there a way around it? Should I wait a little longer until I have started new job which would be mid to late summer? I could show deposit records, money in the bank and other assets, etc, but I'm not sure how they will look at this. Form I-134 asks for my employment details in section 7 in regards to who and where my employer is and what my annual income is. I could probably also get a commitment letter from new employer stating my start date, salary, etc if that would be helpful.

As always, I'd appreciate any advice. Maybe someone has gone through a similar circumstance, thanks.

Timeline

You need a current an ongoing job at the time of the K1 interview. Past tax records are needed too, but the current and ongoing is the most important.

Keep in mind that it takes 6-ish months from filing to interview, so you will likely have been in your new job, and be able to show several pay stubs, by then.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

You are just filing the I-129F petition (income information is not needed), this can take upwards of 5 months to be approved. The support evidence isn't needed until the embassy phase... months from now. You should be able to move and be done by the time your approved petition reaches Manila.

You are just filing the I-129F petition (income information is not needed), this can take upwards of 5 months to be approved. The support evidence isn't needed until the embassy phase... months from now. You should be able to move and be done by the time your approved petition reaches Manila.

It’s just that from reading others posts, it would seem (anecdotally at least) that many cases are going through relatively quickly. Of course this is what most of us would hope for, but potentially if I am one of those cases where that occurs, my concern was that the timeframe would be when I am between jobs.

It is likely to be on or about August 1st, which is approximately 3 months from today, so in theory, if I was to file today by interview I should be employed and obviously be able to provide occupation, name and location of employer, a few pay stubs, etc. Is there any kind of minimum time required to be at a job? I couldn't find any requirement for that, but was told by a visa service that they look for at least 6 months history. I would think there has to be a common sense approach that would prevail when people move and/or change jobs and there is some type of gap in between, but maybe that is wishful thinking.

It’s just that from reading others posts, it would seem (anecdotally at least) that many cases are going through relatively quickly. Of course this is what most of us would hope for, but potentially if I am one of those cases where that occurs, my concern was that the timeframe would be when I am between jobs.

I have to discuss actual start date of new job with my new employer today. Here is the thing, embassy will want your most recent tax return and W2 (according to the embassy instructions letter), being you are with a new employers include a letter from your employer stating your yearly income and such, then include copies of pay stubs. It is not a big deal at all.

After all of that it is entirely possible the embassy won't ask for any of it, it has been hit or miss on requesting support documents with the K-1 over the past two years.

Here is the thing, embassy will want your most recent tax return and W2 (according to the embassy instructions letter), being you are with a new employers include a letter from your employer stating your yearly income and such, then include copies of pay stubs. It is not a big deal at all.

I already have most recent tax return and W-2 so that is not an issue.

I should also be in a position to provide a letter from my employer stating yearly income and pay stubs, so it sounds like I should be all set.
