What can I expect when I arrive in the U.S.?

Once at the port of entry you will find that many of the procedures remain unchanged and are familiar to you. For example, a U.S. Customs and Border Protection Officer still reviews your travel documents, such as a visa and passport. The officer still asks you questions about your stay in the U.S.

What’s new under US-VISIT is that the U.S. Customs and Border Protection Officer now uses the inkless, digital fingerscanner to capture two of your fingerscans. You first place your left index finger and then your right index finger on the scanner. The officer also takes your digital photograph. These procedures add only seconds to the overall processing time.

What do I need to do before I exit the U.S.?

Chicago O’Hare International

Dallas/Fort Worth International

Why do we collect this information?

The biographic and biometric data are used to match your identity against the data captured by the State Department at the time the visa was issued to ensure that you are the same person who received the visa. In addition, your digital picture that was taken at the visa-issuing point is displayed to the U.S. Customs and Border Protection Officer for visual comparison and confirmation.

Using all these tools, the U.S. Customs and Border Protection Officer will then either admit you or conduct additional inquiries based on the verification results. These procedures reduce fraud, identity theft, and the risk that terrorists and criminals will enter the U.S. undetected or by using stolen or fraudulent documents.

Just something that occurred to me. She came over with a fake passport right? So the OP is stating that if he sends her home and starts the K-1 they won't know she overstayed because it was on the fake passport? But...when you come over to the States they take the finger prints of your forefingers, so they have them on record.

So, say he does send her home to Peru and goes the K-1 route with her real name, won't they check her fingerprints through the database? If she has been here before they will have a record of the forefingers and it will match it to the ones in her real name. So they will automatically link her to the fake name?

Or am I talking rubbish? :wacko:

mags, the 'fingerprinting' is a fairly recent development (late 2004 I think). So it depends on when she traveled if there might be 'connecting dots'.

They do not fingerprint people when they leave, as a matter of fact, they dont even care about people leaving.

So when they collect the I94's, they just throw them in the trash.

Don't be sarcastic... you know very well what I meant.

First of all, you know as well as I do that many people for whatever reason don't turn in their I-94's when they leave the country, my wife's mother comes to the US twice a year on a B2 visa and she told me last time she was here, while we drove her to the airport that only ONCE she was asked for her I-94 right before boarding the plane at the gate... she told me she still has some of them with her just because she was never asked for it and when you are trying to find you gate and trying to carry your carry on and so occupied with the trip you forget about turning it in and it has never been a problem.

I'm in Arkansas and have seen two lawyers about my case. The first gave me not one, but two free consultations and gave me completely bogus information that could have lost me valuable time and lots of money trying for applications that would have untimately been denied. I could not find any evidence to support what the first lawyer was proposing for me so I wanted a second opinion.

The second lawyer charged a nominal fee ($75 for an hour) but knew her stuff and gave me excellent advice. Much information can be found online if you do some research and if you get advice that seems too good to be true try to verify it for yourself or get a second legal opinion. That would be my advice and for goodness sake, as everyone is telling you, get some kind of legal advice!

Background Posts: FIRST and SECOND

Well first, I just want to thank everyone for their help, thi forum is very helpful, the people here quickly respond and best of all, from what I have seen, very friendly (First forum i've seen with no flame wars :thumbs: )

I have hit a lot of road blocks and a lof of you have helped me ram right through them without damage, but I am afraid I have hit the mother of all road blocks as of today and do not think that I can ram this one down or go around it. Although I do not want to, I am just going to lay it all out. I just recently got of the phone with my fiance, talking about the I-485, I-130, etc. pretty much all the forms we need to fill out to adjust her status from her overstayed tourist visa. Now (HERE COMES THE BAD PART) I knew she had another passport and visa with another name for reasons I don't think are too important to state because it's pretty obvious why. But, as of today, I found out she entered the US with this false passport and visa. We discussed this situation before when I met her, but I must have overheard her about the part of here entering the US with the false documents. So it turns out, yes her visa is expired, and yes she has overstayed, but not in "her" name, but the name in the other passport and visa. From here, I do not even know where to begin. I know she has to go and I told her that, but came her for maybe some advice or help, or maybe someone has been down this road (hopefully), I sure would like to hear their story, especially if they are now married and living in the US.

I know little about visa fraud and I am sure that my fiance has comitted just that. From seeing the term pop up a few times here, I know it is something to be feared.

Here's What I Have Been Thinking About As A Solution (From Worst To Greatest Idea):

1. Continue to apply for the AOS (I don't think this is now possible in my situation, even if she was married to me. She now does not have a I-94, which I believe is require to even apply, correct?)

2. Send her home and apply for a K1 Visa (If I did this, then our story on how we met would need to be modified during the interview and that is something I do not want to tinker with)

3. For me to move to Peru and live there happily ever after (this I do not want to do, but seems to be the perfect solution :crying: )

Let's see, I have been sobbing for about 4 hours now and my body & heart aches a whole lot now, if anyone can provide any, please :help:

I have heard about a person who won green card after he enter US the same way as your fiancé. He went back to his home country using the “other” passport and successfully processed the application.
