My name is Li,I'm gay. My bf is American. We've been living together in Beijing for over 11 years.He's been working for the same language school in Beijing over 11 years as well.Our story is unusual is because of many reasons.No.1,our age difference;No.2 our nationality difference,I'm Chinese,he's American;No.3 our background difference especially between oriental culture and western culture......Our life has been up and down many times,I can't remember how many times I wanted to give up this relationship as I couldn't face with his leaving China for the States some day,as at those days same sex marriage wasn't legal in the States.I still remember in 2009 he had to leave China for US for surgery,that was the most difficult time for us.On one hand,we didn't know how long he would be gone,u know the surgery which might take long time to recover,on the other hand,I didn't know what to do what if he couldn't come back to China any more,could I still be able to continue my life with him?We've been together so long although we weren't marriage(couldn't be done in China or US),we just had each other for the moment,but with age going,he eventually would had to leave.When I met him,he was already 60 years old.I'm 30 years younger than him.I always like older men like my father's age as gay man,especially older white males. OK,it's not the most important part of my question.Let's just put it this way,everybody has own type.So in 2009 after he booked air ticket,we started to discuss what to do next,I was preparing the worst part which was he couldn't come back cause of medical problem.I would have to mail all his stuffs back to US......I remember that day I took him to the airport,it might be the last time I saw him,I couldn't kiss him in public because of gay thing,Life was just so unfair for me.We love each other like straight people......I remember the message I sent to his cell phone before his flight taking off.I told him"My love,I just wish we could grow old together",I was crying at that moment,is that too much for ask to grow old with someone u love?

He did come back 4 months later,we were lucky school still kept his job as he's the best teacher at that school.My bf is the kindest person I know in my life.He's divorced twice and has adopted a few kids.His own kids r one boy and one girl.I met his daughter and son-in-law once in Beijing.I also met one of his sister's family once in Beijing.He's not out to his own family,so all he told his family is I'm just his best friend in Beijing and we've been living together for many years.......

Until 2013,when I read news about the really important case in the States,which was about same sex marriage.HBO has document called "the case against 8",I watched the whole program and cried aloud in the end.Same sex marriage is finally legal in the States,that means my bf and I can finally decide to move to the States.in May 2015,we turned in our application of K1 visa to the states.as my bf isn't living in the states,we hired agency to handle file for us.on June 1st,2015,we received NOA1,our case was accepted.Until now,it's been almost 11 months,we haven't received NOA2.We tried to contact USCIS last December,the officer said our case was pending.Couple weeks ago,we contacted USCIS again,they told us our case pending security check......

I just wonder,as my bf isn't living in US for many ys,FBI has difficulty to track his recorders of 11 ys since end of 2004 till now?My bf only travels back to states once a year to visit his family and getting his pills,he's heart patient and has diabetes.It's been over a year one of his legs started to hurt.It hurt a lot whenever he walks.We hope someone can give us some advice as we really need to get going.I'm really worried about his leg.We need to get his leg fixed in the States.He got the best medical insurance in US,in China he doesn't have that.By the way,he never had criminal record in US.He's been police over 20 ys in US.Is it because he used to be a police,which caused security check pending?

Wow not sure about security checks i assume its because hes been gone so long dont worry you guys will be fine...many years together...i wish you both well.

A few things to just make this case a little clearer:

What is the first three letters of your case number: WAC or SRC? This may help to clarify where your case is right now, and why it may be taking so long.

Secondly: Calling USCIS will get you nowhere, there is nothing very helpful that they can or will tell you, and they routinely give out false or misleading information.

What you can do is put in a service request with the USCIS. That is going to take some time, but you are well outside any posted processing time. Other things you can do: your fiancé should make every attempt to contact his senators and congresspersons. It's one of their jobs, and often they may be able to assist. You can also put in a complaint or request to the Ombudsman to discover what is going on regarding the case.

thanks for reply,Yuna,our case number starts with WAC;Yes,we have been trying to contact couple congressmen couple weeks ago ,only one of them replied,but she said my bf was't living in her district,she couldn't help us with it.The matter fact is that my bf doesn't live in the States,that means all congressmen would tell us the same thing.......

Do you and your fiancé intend to reside in the US together should the application be approved? Try a senator rather than a congressperson. Ideally though, your fiancé should be establishing domicile in the US, if the idea is for you to marry on the K1, and adjust your status to live and work in the US.

WAC is California, so it would be very unusual for such a case to be delayed like this. Some other posters may have additional suggestions. I'm not saying the file could be lost or something is amiss, only that you absolutely need to put in service requests.

Do you and your fiancé intend to reside in the US together should the application be approved? Try a senator rather than a congressperson. Ideally though, your fiancé should be in the US, if the idea is for you to marry on the K1, and adjust your status to live and work in the US.

WAC is California, so it would be very unusual for such a case to be delayed like this. Some other posters may have additional suggestions. I'm not saying the file could be lost or something is amiss, only that you absolutely need to put in service requests.

Yes,our goal is we live together in US for the rest of our life.As I said,he's not young any more and had medical problem.I'm not getting any younger either.As my bf doesn't own property in the States,we r planning to buy a house with our savings of 11 years in US.I wanna go to skill training school and start new life.

the reason why we've been living in China for so long was because same sex marriage wasn't legal in US or China.what could we do?we r not straight couple.We didn't have choice like straight people who can decide to get married or not.Our final goal is get marriage like straight ,it's about human right.We r not freak or second class citizen.


Wow not sure about security checks i assume its because hes been gone so long dont worry you guys will be fine...many years together...i wish you both well.
