Hi,

I sent out my AOS packet about three months ago. Since I already had a EAD card though OPT(good until Nov 2016), I didn't file I131 and I-765. In case I couldn't get my GC by the date my current EAD expires, I'm now asking my lawyer to send out the application for EAD/AP. He emailed me that Advance Parole will only be granted for “urgent humanitarian reasons” or for furtherance of a “significant public benefit.”. So he said I should have a separated document explaining why I need to travel for "urgent humanitarian reasons". I'm not planning to travel aboard until I get my GC. I'm doing this only in case any urgent situations happen that requires me to travel. Would that be a reasonable explanation?

Yea, I feel like I've been to this site for a while but never heard anyone having issue with this. But he mentioned that it was according to Part 7 on I131, I took a look at it and it does state that "On a separate sheet or paper, explain how you qualify for an Advance Parole Document, and what circumstances warrant issuance of advance parole. Include copies of any documents you wish to consider". Should I just ignore this?

Also, since I already paid for I485/I130, how could I make sure they won't ask me to pay for my EAD application? My lawyer has given me misinformation few times before, I really want to make sure I know the process so that it won't cause me some extra time. THANKS for your help!

For an adjustment applicant, no reason or explanation needs to be given on the form, and no separate sheet is required either.

As for the fees being waived, you need to include a copy of the I-485 receipt from filing along with those forms.

I agree with the others. Your lawyer should know these things.
