Hello~

My Background Story:

I went to America when I was four years old. I think my mother had a student visa and our whole family went with her. We never became permanent residents but were living in America on that expired visa..... I found this out when i was about 15.

My father got us DACA but since it was irresponsible to continue to be in a country where you're not legally there, so i went to korea when I was 17 in 2014.

So, I have a boyfriend in America and we want to start the process of the K1 visa.

Question: Is it possible for me to apply and get the visa even though I violated immigration laws??

Help would be so much appreciated.

You should be fine. You'll get asked about your immigration history at the interview, but since you left while still a minor, you have no ban.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I know a lot of people say you should just do it on your own but my process might have few complications.

First: I went to america when I was four on a visa with family. I stayed on an expired visa until I was 17. I heard since I was under 18 I'm not responsible for the immigration violation. However would it make the process even more complicated?

Second: my bf in america got charged with something minor. Could be still go with the process?

I do not know much about your immigration violation issue. But the fact that your bf has been charged is not a problem for K1 application. Because they do not check his police clearance.

If I were you, I would have a lawyer. Your immigration violation would at least effect consular's judgment or opinion on you.

I would love to hear from a person with a similar experience.

What additional forms would i have to fill out?

Will the person whos going to interview me going to think its fraud?

I doubt if you will have any issues, did all your family leave?
