Hello,

My husband went to info pass appointment this past Friday and they told him to go to the interview on May 12th alone. She also said that the worst that could happen is that they request more information or reschedule so that I could attend.

things he are taking with him are:

  • Letter and contract from my employer including recent letter from VP of Operations as to why I needed to be in Scotland for my job
  • DL his and copy of mine to show same address
  • Letter from son school with address and attendance confirmation
  • Cable bill in his name
  • letter from his employer
  • SS card
  • EAD card
  • Joint bank statement
  • letter from my employer which includes beneficiary on my life insurance policy and 401k
  • Marriage certificate and wedding pictures
  • 2015 tax return which includes him and his son
  • ITIN for his son

Can you think of anything else that might help. He is nervous so am I but was a bit reassured that we would only be asked for more information. I also heard on here that we could refile worse case scenario.

Well she lied. The worst that could happen is it could be denied. You've fallen victim to the misinformation line. That being said, you can always reapply again if needed. Good luck, your evidence looks good.

That is just crazy to me. I would expect that from the telephone customer service reps but not from the INFOPASS at the Immigration office. He said that she said it is very common that a spouse is out of the country on business and reassured him with the proof from my employer it would not be a huge deal or reason to be denied. SMH. Should I tell my husband he could be denied or just let him go and see that they do? He is worried and I feel so bad that I can not be there.... I better tell him what you said. thanks.

I have a slightly different view. I mean from what Ive read in your other thread you tried to reschedule the appt but need a date far out in the future and they are not willing to give that you.

The people at infopass know the specifics of how their office works. I am inclined to believe them strongly over the phone reps. You also have to realize they dont want to deny people and have them start at the beginning of the long process again. Theres paperwork involved. A lot of paperwork for them and if they know you are just going to reapply or appeal then it makes it pointless for them to do all that paperwork. This is why a lot of people who are denied never get referred to court. Or it takes months and months before it happens. Because the officer is waiting to see if they reapply before starting the court ball rolling. The courts are pretty backed up/

So if infopass said they will most likely reschedule or approve on his own with proof you are out of the country for work then I would trust them. As stated the worst that happens is the officer denies and you reapply or appeal for a new interview. I am concerned because you did say something about needing the appt in July. If he gets an RFE it would be for 30 days. Thats not July. Also if they reschedule it may be before July but I would think you could change that appt to after July once its issued with little problem. Moving the interview into the next 30 days is usually okay. Going beyond that is not as you learned the hard way.

I would honestly try to find more evidence. The more the better. I didnt see anything listed that was described as an affidavit from you. Phone bills, lease, personal communications. I mean I know this is for the initial AOS and not ROC but look through both the ROC forums and AOS forums for items people brought as proof and you may come up with more evidence.

Also tell your husband to not stress so much. It is how it is. Everything will work out one way or another. You guys are just having a tougher time with immigration but its GOING TO GO THROUGH one way or the other. Does he think youre going to let him go that easy> lol. The system is the system so you work with it. Its worth it in the end.

Meh technically they should be denied. Or rather he would be denied. Its happened before and its honestly what is suppose to happen. But I dont believe they will be. Like I said the infopass worker saying it would be OK is a very good sign.

If they know the supervisors in that office are sticklers for the rules they wouldnt have made it seem like it would be okay they wouldve just been snarky and told you to both show up or refile before shutting the window on your face.

Anything can happen. People have been approved with out their spouse, people have been flat out denied and people have been given a second interview. You are prepared for all possibilities so try to enjoy Scotland while you are there. Post back and let everyone know what happens.

My opinion is not to tell him. Why get him all worked up for possibly nothing. You said he's already nervous. Why make it worse, make him even more nervous, and flop the interview. Not necessary. It's only speculation. Give him positive vibes.

Thanks everyone. I will let you all know what happens after May 12th.. Lioness.. You already know it has been a battle from Day 1!! I don't expect this to be any easier than it has been haha.. I have been keepin my husband positive.. remember more than anything,,, I have left him in the US by himself :( I miss him tremendously and this has been hard on us both. things will be ok or they wont and I will be home soon to fix them.. As I have always done.. No he will not get away that easy.. :)

I've been following your struggles with the USCIS from the sidelines and I just wanted to say good luck! I really hope it's a non-issue when he shows up at the interview with the mentioned evidence! And yes, the more the better! :)

05/07/2018 - ROC packet sent off

Yes, please update me/us! I know your struggles...I'm still living them. We are going on 2 years just to get his visa issued. I seriously doubt AOS will be any easier, if we ever get that far. It's exhausting. You will be just fine. You're a fighter, i know! :yes:

Sadly a lot of people working for USCIS has no clue. They are a bit more knowledgeable than the customer service people but there's still big gaps in their knowledge.

Well everyone to add fuel to the fire my husband went today to the interview and was told the interview was yesterday! Omg...I'm devastated..we have been saying Friday May 12th and it's actually the 13th! I could scream. We have enough issues with me being in Scotland than to miss the interview. In any case he went in to see the agent who had him write a letter and attached it to the interview appointment. He told my husband that he would receive a rescheduled interview within 45 days. And im home in less than 50 days. I will be so grateful when this is over and we can put immigration out of our lives for the next 2 years. I'm speechless at our oversight which is so very unlike me to make this type of error. I'll keep you updated as to the outcome of yet another fiasco. :(
