I have my SSN from my J1 visa. Most J1 visas do not have a 2 year requirement, I didn't have it!!! As fas as I know medical personnel has the requirement. But kinzazaa, you can see that on your DS 2019.

You cannot necessarily trust what it says on the DS 2019 (or if you're an oldie like me, IAP-66) or the visa stamp. If in any doubt its good to get a ruling from the State Department as to whether your are subject to 212(E).

Usually if you're from a first world nation, the only reason you have the 2 year HHR is because you were either funded on the J-1 by your government or directly from the US government. If you're from a less, shall we say, wealthy, country then there are lists of jobs that are covered by 212(E). So for example if you're a dog groomer and come from Inner Fromgolia, that has a national lack of dog groomers, you're likely to have the 2 year HHR.

But kinzazaa, you can see that on your DS 2019. If the box with the 2year requirement is checked, then you have to stay 2 years in Moldova before you can reenter the US with a K1/K3 visa. If you served the two years in your country there is NO NEED for a waiver, since you fulfilled the two year requirement!!! If you want to go back to the US earlier, you can apply for a waiver which is mostly granted in marriage related cases.

I could use my SSN without any problems. I just got a new card with my married name and no DHS print on it.

Thank you for your reply. I did have a 2 years requirement when I first went to the US as a high school exchange student (when I was sponsored by the US government). After that I lived in Europe for 2 yrs and then went to the US three times more on a J-1 working visa which didnt have the requirement and that is when I got my SSN. So it'll take a while for me to become Mrs. Casey officially huh? I so like that last name :P

since only your High School year had the requirement you should be fine! Your last visas didn't have the requirement, so no waiting-time. :) If you want to make that sure, copy all your DS 2019's and visa related paperwork and send it to your hubbie, as an American he should understand American paperwork better! :P

@ Dr Lha: I was a trainee in NYC, mostly working with other European trainees (France, GB, Romania, Italy). None of us had the requirement, only some girls we knew who were doctors (but they were sponsored by the German gov).

I know, but only medical personnel gets sponsoring! I think a girl from Spain who's a teacher was sponsored as well, but the point is, if you work for businesses, you usually don't get any sponsoring.
