I was just wondering can they disapprove NOA2 and what would be the reason and what are the next steps then?

has anyone ever got it?

just curious on a snowy and cold friday morning in new york.

People will tell you no, that NVC does nothing more than process paperwork and makes no decisions but it is not true. About the only thing that can happen between the NOA-2 and the interview is that you get flagged for Administrative Review which is what happend to me at the NVC. It is a big black bottomless pit that you don't want to fall into.

12/14/2006 Applied for K-1 with request for Waver for Multiple filings within 2 years.
Waiting - Waiting - Waiting
3/6 Called NVC file sent to Washington for "Administrative Review" Told to call back every few weeks. 7/6 Called NVC, A/R is finished, case on way to Moscow. YAHOO!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!
7/13 On Friday the 13th we see updated Moscow website with our interview on 9/11 (Hope we are not supersticious) 9/11 Visa Approved. Yahoo.
10/12 Tickets for her to America. I am flying to JFK to meet her there. 12/15/07 We are married. One year and a day after filling original K-1
12/27 Filed for AOS, EAD & AP 1/3 Received all three NOA-1's 1/22 Biometrics 2/27 EAD & AP received 4/12 Interview
5/19/08 RFE for physical that she should not have needed. 5/28 New physical ($ 250.00 wasted) 6/23 Green Card received
4/22/10 Filed for Removal of Contitions. 6/25 10 Year Green Card received Nov, 2014 Citizenship ceremony. Our journey is complete.

People will tell you no, that NVC does nothing more than process paperwork and makes no decisions but it is not true. About the only thing that can happen between the NOA-2 and the interview is that you get flagged for Administrative Review which is what happend to me at the NVC. It is a big black bottomless pit that you don't want to fall into.

what is administrative review and how can anyone avoid it?

Petitions get disapproved all the time. The disapprovals are based on not meeting the filing requirements. Not having met in the past 2 years will prompt a disapproval. One of the parties not being free to marry on the filing date will prompt a disapproval.

You would think so. But there have even been questions posted on VJ asking if it was OK to submit the petition earlier if they would be free to marry before the consulate interview.

so when can you refile?

When you meet the requirements. It's only logical!

Quality control is a pretty good answer.

Administrative review is when they think they see a red flag someplace. It might be that the applicants name is Al Capone and they want to make sure the real one is really dead. I am guessing it is more common since the IMBRA law. I see a lot more people talking about it than I used to. I have even seen a case go into Administrative Review after the interview where they were told it passed and before the visa was sent out. Mine hit at NVC after my NOA-2 and before the packet was sent to the Embassy.

I have no idea why mine was flagged. It is the second K-1 for me but if that was a problem it would have been decided at VT. It is also the second K-1 for my fiancee. I have a feeling they saw there had been another K-1 for a beneficiary with the same name and address and flagged it to make sure she returned to her country and did not overstay the visa which she did not.

I don't think there is anything you can do to avoid it. Typically it will delay you about 3 months. One vj'er has been in A/R for 9 months. I have heard of one lasting 3 years and another lasting 8 years.

Then that's a whole different question.

I thought you meant USCIS disapproving the petition.

DOS cannot disapprove an approved petition. They can, however, choose not to issue a visa and recommend to USCIS that they review their approval and reverse their decision.

What exactly is your question? Is it possible that someone will not get a visa even after getting a petition approval? Yes.
