Question about ICE and Master Court Hearing (merged threads)

he won't get bond, period. End of story. Ignoring the situation and hoping for the best will get him nowhere but a one way trip to Jamaica. My friend married a man from Turkey. He was in overstay exactly like your husband, was married to another women, divorced and never removed conditions. BUT and this is a BIG BUT, he did not have any felony criminal charges against him , not even a speeding ticket. He was driving one day and was pulled over by the police, he of course had no green card to provide so off he went to immigration lock up(this was in NYC). He had his hearing and had his very "competent" immigration attorney wit him, an attorney who told them the same thing before he was arrested, that all they needed to do was "get his citizenship"and failed to mention the removing of conditions part from his first wife. Long story short, this attorney filed for citizenship for him, citizenship he was NOT eligible for before he was arrested. Charged them $5000 to file it not including the fee for citizenship, charged them another $2500 to show up for immigration court and and attempted to explain to the judge that he has filed his citizenship papers and pleaded for his release and he assured the judge in no time his naturalization papers would be approved and everything would be hunky dory and everyone would live happily ever after. The judge LITERALLY laughed in his face and told him he should be ashamed to be claiming to be an experienced immigration attorney, went on to explain to my friend and her husband that their bozo of an attorney failed to tell them their is no citizenship without a 10 year green card and said if he had it his way lawyers such as the one they were paying thousands to for giving people false hope would be disbarred. My friends husband was promptly deported back to Turkey, the judge did not give them the opportunity to get his green card situation and overstay straightened out. That was 14 months ago. In the end the my friend and her husband divorced. There is no way he can ever come back to the US and she cannot move to Turkey as she has three children from a previous marriage, one in college and the other two are still in high school. Their lives were torn apart, they are both heartbroken,they used every penny they had to pay the "attorney" to file citizenship and borrowed $2500 from her sister for him to show up at her husbands hearing.

Moral of the story, ignoring the reality of your husband's situation and hoping for the best will get him nowhere except a one way ticket to Jamaica, which I'm sure is already in the cards. Why on God's green Earth do people come to this forum asking for advice then ignore said advice? Why bother asking when you know you already plan to move ahead with the way things are already going? Seriously WHY???????

I believe that some come simply to vent. Some come in hopes of affirming their belief of what lawyers or their own research/ideas tell them. Some for comfort.

Maybe you misunderstood me. We do have an attorney. And when I said hope for the best, I meant I'm hoping he won't get deported at the end of the process.. I'm not ignoring anyone's advice. No need to get your panties in a bunch hun. Whats wrong with hoping for the best? If I don't I will drive myself crazy.

I didn't misunderstand a word you said. I understand you have an attorney who is lying to you, and everyone else in this thread who has replied understands the same. There is nothing wrong with hoping for the best, but hoping isn't going to save your husband from certain fate because you have an attorney who is ripping you off and flat out has no clue what he is doing. You are ignoring the advice of very knowledgeable people in this forum, I don't claim to be one of them, but I do know of someone who was in a similar situation MINUS the felony gun charge and things went south very fast for him.

I hope to win the lottery.

But I do not plan my life on that hope.

I hope the same, but first I need to start buying tickets.

My grandmother told me every time I saw her, I'll buy you a horse when I win the lottery. She even bought tickets!!! But she died 4 days ago at age 93. I never did get a horse from her. Right now I'd be happy with a hug.

You need to be asking your/his attorney some very direct questions. How does he plan on your spouse obtaining citizenship when he doesn't even have a green card. How does he plan on getting him a green card. What is he going to file to try to keep your spouse from being deported. These are things you need to be discussing with the attorney.

I second this. It seems likely from the story that this lawyer has been taking advantage of you and telling you straight up lies. Has he ever filed anything for your husband prior to this arrest?

To the question if his kid have Jamaican PP for what? they born right here.

OP you are putting the saddle B4 the horse, he cannot apply for naturalization with no LPR status.

Get both his criminal & immigration atty. one will file necessary papers & proof he was locked up during

the time he should receive letter & report to immigration hearing, and the other do what he can do best,

if dates prove hubby was irresponsible in looking about his affairs, caught with & illegal gun, and did not

try to straighten his status prior to ICE picking him up it shows his inability to live by the rules, & being allowed

relief will like be immigration root canal....he did not even bother to ROC.

Start looking at his plan B, where he will stay if sent home & tap into links for a job there, the country-side much

better than the city to live & work, if you decide to go with him USC obtain job permits within 6 mths with

a spouse there & get hired a lot in the tourism industry....best wishes

I hope I'm in the right forum but here's my story. I am an American born citizen. My husband is from Jamaica. He came here in 2006 on a work visa. He was married once before in 2007 but after he caught a case and was sent to jail, his wife divorced him. We have been married since 2014 and we gave almost 3000$ to this lawyer who still hasn't helped us with his citizenship papers. To fast forward. He got locked up in county jail and now ICE has him an an immigration jail. He goes for his master hearing next week and I want to know what does that involve? Will they try to deport him? We are married, have kids, and I don't know what I will do without him. We are hoping they give him a bond. He will have our marriage license and our children's bc.. Plus I am going to type a letter to the judge. Some bad things are. He caught a felony gun charge back in Texas in like 08. He has served his time and all we want to do Is get him right so we can move on with our lives. Anybody know about this? Any input or advice is appreciated. Thanks

Sorry but this is one of the phrases that I utterly hate. How did anyone just "catch a charge"? Did they run out and say hey throw me a charge and let me go to jail. That phrase is what people say when they do not want to take responsibility for the the things that they have done.

I hate to be the bearer of bad news but your lawyer scammed you and just took your money. There is almost no way that he will be able to stay in the country legally and he certainly will not be able to become a citizen. What was his first charge for?
