do I have to come back to the US to file the k-3?

Timeline

I'm currently in the US but am going back to be with my fiance in Albania in a few days. We will get married there in a month. Do I have to come back to the US to file the k-3? Or can I file it while staying in Albania? :help:

My Timeline

04/22/2007: Marriage

10/25/2007: 1-130 sent

01/19/2008: NOA1 for I-130

01/22/2008: I-129F sent

01/31/2008: NOA1 for I-129F

03/28/2008: NOA2

05/15/2008: Packet 3 Received

06/11/2008: Packet 3 Sent to embassy

07/29/2008: Packet 4 Received

08/11/2008: Phase 1, Medical Exam

08/13/2008: Phase 2, Actual Medical Exam

08/25/2008: Interview

08/27/2008: Visa in hand

Do you mean file your petitions? It makes no difference where they are mailed from, it does matter where they are mailed to.

As a practical matter, you will need to have your hands on the Receipt Notice for your I-130 in order to submit an I-129f. That will take some logistical preparation if you will be in Albania.

Yes, this is exactly what I am dealing with right now. I am staying in Cancun and had my Mother take our I-130 petition back and mail it in from Ohio. The tricky part is getting that receipt letter. My "address" is in Cancun, but my mailing address (the only dependable one of the two) is my Ohio address. All I could think to do was explain this in my cover letter, stating that they need to send it to Ohio or I will most likely never receive it. I'm not sure what the mail situations are like where you will be staying, but this is definitely something to work out before sending in your packet.

Someone on this forum have posted that he received his NOA at his Japan address. It took 2 weeks for him to get it. International mail is unreliable.

Indeed they may - cover letters may not make it past the trash bin in the sorting room, long before the case file gets to an adjudicator. Important information should be written on or attached directly to the relevent form.

Sure you can do it. First send your I-130 petition, wait for the NOA1. Second, send the I-129F (K3) petition with the NOA1 from the I-130. So you'll need to get a hold of that NOA1. Through this route, you'll need to wait about 1 month to get the I-130 NOA1 in order to file K3.

How long will you be away? How about going through the K1 petition? You can mail that before you even leave, but cannot get married there then.

I-129F NVC forwarded to Rio Consulate: 03-09-07 :)

03-14-07: Rio Rec'd our case

03-19-07: Requested update on our case via email - (note: by this time we have completed the medical exam, police certificates, and all other related docs).

03-20-07: Received an email with an interview date

04-19-07: INTERVIEW DATE - SHE GOT HER VISA!!!

04-24-07: VISA Received (Xpress Mail)

05-24-07: POE - Los Angeles

AOS & EAD

06-19-07: AOS & EAD sent to Chicago

07-12-07: BIO appointment

07-16-07: RFE for AOS

08-27-07: EAD production notice (email notice)

09-04-07: EAD approved (email notice)

09-07-07: EAD CARD received!!!

09-11-07: SSN card application

11-08-07: AOS Initial Interview - Approved for Conditional (2years) Green Card!!
