This will be my second fiancee visa last one was 12 years ago but me and my wife and decided to call it quites but i have met somone new and want to bring her to the us.. But the problem is I was meeting people online and met a girl that had 18 on profile but ended up underage.. god how my life has changed I was in the military and cant belive what they put us though in this country and how most people think its ok.. Anyway I am curious how hard is this adam walsh waiver to get. Which makes no sense to me in the first place but thats another story. I know i will have to use an attorney this time.. Anyone who has any experience please message me or post.

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

If your petition would fall under Adam Walsh you will need an atty= good one

Most of these cases are denied regardless of victims age , there has been a few

approved with very strong arguments+proof ...USCIS looks at this very seriously.

The beneficiary cant have minor kids or plans to have kids, they must know all

details of the case...no excuses are allowed under age 18 stands

Cases with AWA-related problems are extremely difficult to get approved.

As stated, the overwhelming majority of such attempts are denied. You need a competent attorney to have any chance of success.

This is very difficult as you must prove you are no risk, not that you are little risk or unlikely to be a risk. There is a lot of proof that you need to provide, the few I have seen that have been approved seem to no longer have to register as a rso, they have had continued therapy sessions past the end of their sentence, polygraphs to show that no other crimes were committed and prove that you are an upstanding member of the community since completing your sentence.

You need to be completely honest and open with your fiancé about what you did, during their interview they will be asked about what you told them about the conviction you have, when in the relationship they were told and how they felt. If the examiner thinks that you lied about it or minimized it to your fiancé then that won't go down very well.

You don't happen to be the US citizen fiancé of someone who has already posted on here are you?

To add to this its reported somewhere since this law came about

only about 20 ppl have been approved up to 2015.

They are also leery if the beneficiary is of child bearing age, even

if you both say you wont get pregnant, no one can judge without

facts but don't attempt to imply that the country did you wrong,nor

should she give them a water-down version of what happened, this

can only be something you did to yourself, because unlike in some

countries this not taken lightly in the US. so the treatments meted out

is in accordance to the crime itself...again.....Speak to an Atty

No i'm not fiancee of someone that posted on here. And to that guy that says he thinks its fair and dont blame the us. I was on a dating site you had to be 18 to join. I had proof but not knowing was not a defense they gave me probation then the nightmere started.. Depending on the state u live in they send out flyers to all you're neighbors put it on you're drivers license.. Hell i was given 3 days to move out of the house i owned because it was 1000 feet from a school. Alot of people think oh they are sex offenders kill them or who care but in the us cruel and unusual punishement is sappose to be illegal. Now sex offenders are the only ones who have to get this waiver. If i was a career criminal or killed someone i would be fine.. anyway i'm getting off the topic.. I appreciate the help and advice some members give. This is the only thing i have ever been arrested for but i know it will still be an uphill battle. I dont have kids or want any but again what happened to paying you're debt to society. You do a crime go to jail then u go on with you're life. If i wanted to marry a girl in america i would not need a waiver or say i dont plan on having any kids. Most people think sex offender cant help themself but i have done alot of research on this and there is a study from bereau of justice that actually sex offender are less likely than any other criminal to reoffend http://www.bjs.gov/content/pub/press/rsorp94pr.cfm heres the link for those that doubt it. I know u hear they cant be cured and all sorts of stuff because of a couple sick people out there but when did we start punishing an entrire group of people for the misdeads of a few. Ok, that other person has told their foreign fiancé that they didn't do it and she sounded to me like she didn't know everything, this is a major no no as it can lead to issues about discussing it at the interview. Especially if they think that the fiancée isn't aware of all of the charges or the exact circumstances. Your fiancée will need to know every single detail of the crime, trial, sentence and what has happened since because of it.

You have three choices here as I can see it

1) continue with your fiancée, get a lawyer who has experience with getting this kind of waiver granted, and be prepared for a long process. That might require multiple applications.

2) continue with your fiancée, see if her country will let you immigrate there, and if they do then move to be with her.

3) leave your fiancée and try to meet someone who is from here or already here as this won't require a visa.

Petitioners who were rso are not the only ones who require waivers for their crimes, violent offenders and domestic violence offenders require a waiver showing that extraordinary circumstances in their cases exist.

You forgot to list option number 4 sneak her in through mexico...lol I do plan on moving and living with her in jamaica for a few years and am not trying to bring her to the us right away. I am just doing research now because I will want to return to the us one day. I appreciate all the help, I have seen adds online from lawyers that i guess deal with this. I have even seen adds from psychologist offering there service saying they speicalize in this. I've email a few and will call monday. I mean depending on the price I don't know if i would do it if its just 50/50 odds. I havent been able to find any statistics on it online.

My husband and I are going through this now.   Out of the 400 Adam Walsh waiver cases USCIS received last year, they approved 6.  I am not feeling hopeful about our case, even though my husband has proof that it was a false complaint, witnesses, affidavits, psych reports, you name it.  I would seriously consider moving to your fiancée's country.  As you say, if my husband were marrying an American, no one would care.  Or if he had a murder conviction, no one would care either.  It's ridiculously difficult and we have had an attorney for months prior to applying: we would never attempt it without one.   I'll let you know how it comes out for us: I reckon we're about six months away from finding out a result.   And there is no appeal process.
