Filling AOS with a previous DUI conviction

Hi,

I'm currently filling out my AOS paperwork. I'm confused as to what part I need to mark (if any) on part 3 of the form (questions below). Any advice will be greatly appreciated. My DUI was back in 2006, if this makes any difference at all. Thanks.

"Knowingly committed any crime of moral turpitude or a drug-related offense for which you have not been arrested?

Been arrested, cited, charged, indicted, convicted, fined, or imprisoned for breaking or violating any law or ordinance, excluding traffic violations?"

When it comes to interview you will need a Memorandum of Conviction from the convicting court in the UK, unless you still have original court documents from 2006.

Thanks for responding. I was worried nobody knew anything haha! Okay, at least it not a big problem. I have a my police certificate and a full ACRO subject access report which lists pretty much everything that happened. Do you think those would suffice? I had to show them at the embassy at interview.

When I mark yes for the second question, do I need to add an explanation on a seperate page?

It's really not a big problem. My interview was very smooth. They didn't approve me on the spot, as with a conviction the case must go to a supervisor, but I was approved within a few hours of leaving the building. The officer didn't ask me any questions about the conviction, I just handed over the paperwork and she made it clear that being reviewed by a supervisor was just a formality in a case with one old DUI.

You will need original court documents rather than the police certificate, I think. The certificate is more for applying for visas, but they want to see court documents for adjusting status. The instructions you will eventually receive with the interview appointment say you must have original or certified copy court docs for every arrest/charge/conviction. It was easy to get the Memorandum of Conviction though. I just emailed the convicting court, paid a 40 pound fee, and within a week they emailed me a scan of the doc, then I had the original mailed to me a week after that. When applying for the Memorandum you should stress that you require an embossed or court certified copy. They also produce non-certified copies that are cheaper, but are not sufficient for our immigration purposes.

My lawyer added a very short description on a separate page. She just detailed the conviction, the date of offence and court appearance, then a couple of sentences about how I have never been in trouble before or since that! With the original application I also sent copies of the paper part of my driving licence, with the conviction on it, and the few documents I still had relating to my youth offender program.

I was so anxious about it for months, but the process was honestly very painless! One DUI is not going to be an issue for you once it's over 5 years ago.

Okay, perfect! I'll get on that straight away. It's not just the Police Certificate I have, I have other documents. But no harm in me getting this from the convicting court to save any future problems.
