New Member about to begin CR-1 visa Journey

Hello everyone,

I just want to let you all know that I am so glad that I found this website. It has helped me out so much with finding out information for this process that I did not know about. I currently live with my wife in Germany and we hope to send her I-130 beginning next month. But I keep finding out more and more information pushing me further and further away from sending these documents because of the fear that it will get denied.. But I am sure everything will fall together eventually and I will stop finding new problems and will have the confidence I need to mail this. I am happy to be apart of this forum and look forward to speaking with you all.

Welcome to the forum!

Even if there is a deficiency in your petition, USCIS will almost always send a "Request for Evidence" before denying the petition outright. They even send a "Notice of Intent to Deny", giving you another opportunity to provide evidence before issuing a denial. So, you don't have anything to worry about! Best of luck!

At first the process seems intimidating, in reality it really isn't . I have noticed that things aren't really in stone. What one couple goes through, doesn't mean the next will have the same issues if any. Maybe it is just who is reviewing your petition.

If you don't have a criminal history and some disease that could wipe out the human population then file. The hardest part is reading the directions to fill out the forms correctly. The affidavit of support seems to give most troubles. And then you need plenty patience as nothing moves as fast as we want it to.

Also sometimes filing from abroad gives you auto expedite ......Do you know if you can file DCF in Germany?

Thank you so much for that information.. That makes me feel much better and just lowered my stress level a lot. :dancing:

I will be filing my wife's 1-130 directly to the embassy in Frankfurt, Germany just a short 2hr train ride away from us. I herd that this way is a lot faster because of the auto expedite that you automatically get. But my question is how much faster can it be? I am the sponsor for my wife and will be having to do a joint sponsorship with my mother back in the states because I am currently unemployed out here waiting on my marriage visa to get approved here in Germany. So I am sure that is where most of my problems will arise. But I am having my mother get all that information ready for when it comes time that they need it I can just send it right away with no delay.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Welcome!

You can DCF with Frankfurt if you have had German residency for the six months before filing. From what I've seen around here, the process tends to take three or four months, though it can be less or more depending on the case. See the links in my signature for information directly from their website.

For the Affidavit of Support, your mother can serve as joint sponsor so long as she meets the criteria (income at 125% of poverty line for the household size). You'll also look at showing either that you have maintained US domicile or that you intend to reestablish it no later than the date your spouse enters the US. The I-864 instructions have more information on both of these, and there are many threads on VJ that go into more detail.
