Honestly the Whitehouse Petitions are rarely looked at, and don't always bear fruit. Plus you cannot explain your situation properly. You would have been better off using Change.org

Wow, I guess I shouldn't be too surprised at these responses, but damn... sounds more like a political facebook flame thread than anything constructive.

This process, which I'm sure nearly all of us have undergone or are going through, can bring a TREMENDOUS amount of stress and pain, as most of you well know. That in and of itself should make you even more amenable to understanding the desperation that goes in to petitions like these. I wrote one myself to try to get one going for Canadians to be able to come over like VWP countries with no chance of AOS and just got ripped by people clamoring about my entitlement.

Yes, there are problems with the petition as it is stated. No, it won't kill you to be tactful, logical and objective in explaining why.

Then again, maybe I'm asking too much...

Thre are many peions ou here, everyone highlights what affects them os imes, ohers are

not too willing to take the time to dign , as that relief would not help them...its a fact

For instance there's is a large number of non violent former Military folks that went to

Kuwait Afghan * Iraq to fight, they got a CIMT after returning drug use etc.no violence,

with homes families & lost of SS when they get to the age. They were deported....They have

many petitions & advocacy groups drumming for them But ????

I wrote one myself to try to get one going for Canadians to be able to come over like VWP countries with no chance of AOS and just got ripped by people clamoring about my entitlement.

You can AOS from VWP in certain circumstances.

You can AOS from VWP in certain circumstances.

And Canadians can already come over on better-than-VWP terms: automatically receiving B1/B2 status.

I think you'd get a lot more support for a petition asking to remove the ability to AOS from visitors - tourist visas, VWP, etc. By removing that incentive, they could relax the burden of proof potential VISITORS need to meet.

I would have backed you up if you were talking about applicants bn made to pay "visa processing" fee when a visa is not guaranteed. They can call it something else but not visa processing fee.

You're not paying for the visa itself, you're paying for the process of applying.

Who should pay for the work that goes in to the application if not the applicant themselves?

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

The reason tourist visas are hard to come by in some countries is NOT the legal process of AOS from VWP/tourist visas but rather the illegal act by many to use their visas to enter the US and stay ILLEGALLY.

I disagree, I'd say the reason is both tourists staying illegally AND the people abusing the AOS system.

The only place you will find an issue with AoS is on VJ, nobody else cares.

I've previously called a CBP office to inquire about travel while in the process of immigrating and they said no way. I don't think there's any other reason that they'd care besides AoS.

Oh I'm not saying it's not possible, I'm just saying maybe it varies. They were quite adamant about how that would NEVER happen lol. Of course, they also recommended that my wife apply for Advance Parole during Consular Processing, so...
