my friend met a Filipina who is going thru the annulment process in the Philippines.

My question is, when he fills out the I129F does he use her married name or her maiden name?

sorry for the dumb question.

yes, but he can't file anything until the annulment is complete. Both must be free to marry on the day of filing. And that means its been filed with the NSO already for an annotated CEMAR

I-129F would be in her maiden name. BUT you can't file the petition until after the annulment has been recorded with PSA (was NSO)

Passport - maiden name. NBI - maiden & married name (AKA), CENOMAR - maiden name (this will be an annotated CEMAR in this case)

We submitted the I-129f prior to her divorce (not annulment) being annotated. She had her divorce so we went ahead and filed the 129f with no problems as she was legally able to remarry at that point. With annulments, the whole process is "iffy" at best. As others recommend I would wait on annulment till you have the annotated MC in hand before filing. With A's they can go south fast.
