Hello all,

Beautiful forum you have here. I've been lurking around here for a while, but am finally making an account now that I am getting a little bit of hands on experience in the visa application process.

My wife's I-130 has been accepted and her interview appointment has been scheduled for a month from today. I haven't filed taxes for the past 5 years (2011-2015). Since one requirement is "copies of the petitioner's federal tax returns", what does this mean exactly? Can I just fill out my 5 IRS-1040 forms (for the past 5 years) and simply photocopy them, attaching them in my document package? Or do I have to wait until the IRS replies after I send the IRS my 5 IRS-1040 forms, and then photocopy whatever the IRS mails me and include that in the document package? If so, is there any way to expedite this process?

In case it matters, I have no pay stubs for the past 5 years, as payments made to me went directly into my PayPal/bank accounts.

My husband is having to back-file taxes with the IRS as he hasn't been filing since he's been here in the UK. This is essential even though I'm having his father as my co-sponsor. They'll want to see three years receipts I believe (information is on the I-1864 affidavit of support form so double-check)

I think you'll need this before your wife's interview so may need to reschedule that depending on how long you think it will take (I would imagine more than a month though)

Paypal issues a 1099 form, which you needed to file with the IRS.

Between you and your wife not having any form of tangible paper trails like pay stubs; you will most likely be denied entry.

Why haven't you filed your taxes? You have to do that asap...

Thanks. It is comforting to hear that others have experienced this as well. Would you happen to know the names of any such companies? I've been calling accountants I found on Google since yesterday, but haven't found anyone willing to take this on (although I thought it's a simple matter).

Thanks, I guess I'll have to take a look at that. It's only some of my clients that pay through PayPal. Others deposit checks/cash in my bank account.

I ended up just filling out my 5 IRS-1040 forms (for the last 5 years) and simply photocopied them, attaching them in my document package. I did not wait until the IRS replied--and it's good I didn't because the IRS never contacted me (as I didn't owe any money and they didn't owe me any money).

 

Coupled with this, you'll want to make sure you have a convincing case that you can financially sponsor your spouse (or a joint sponsor that can).

Yes, that's exactly what I did, and yes it got approved. However, I had to also provide proof that I could financially support my wife (but this is a general requirement).

I'm not sure how different the two embassies are. I would hope and reckon the Italy embassy should be more easygoing than the one in Jordan.

My husband wasn't able to pay his taxes from the past 7- 5yrs since he's here in the Philippines finishing his college degree but now that he just graduated and filed the spouse visa via dcf what can we do regarding his taxes return?
