Hi there, new to the boards. We're applying for a spousal visa and are at NOA1 stage. I have two questions:

1. Re: Affadavit of Support, I found this on the State Department website: "No, the NVC reviews only Affidavit of Support forms for petitions filed in the United States with United States Citizenship and Immigration Services (USCIS)." Surely it can't be this easy? (I did check the VJ guide in this section but the links are broken.)

2. The guide says the petitioner needs a police certificate for the UK and also for any other countries they've lived for more than 12 months. My husband lived abroad for four years from 1985-1989 starting when he was 12. Will he need one for this period even though he was a minor?

1. DCF filers skip the NVC altogether so the embassy will be reviewing your I-864 at your interview.

2. Required for all countries where you have lived for more than 12 months since the age of 16 and any country where you have been arrested, even if you were not resident there. You can review the documents required for your interview on the London embassy website. https://uk.usembassy.gov/visas/family-immigration/required-documents/

1. I guess my question is how does the AoS work if both of us live abroad? I've been here for 15 years and have no income in the US. I wasn't sure if the requirements would be different when filing from abroad. I guess we'll need to get my (retired) parents to be his financial sponsors? Sorry if it's a stupid question!

You will need a US Domicile, some people go back and get a job others use a joint sponsor.

Same requirements. You as primary sponsor of your spouse MUST submit I-864 and latest US tax return. You won't have income in US, but assets can count as well. If not enough, then you can get a joint sponsor who also fills out an I-864.

Any sponsor (primary or joint) must have US domicile. Joint sponsor will submit proof of citizenship or greencard. Since you likely have no current domicile, there is a work around allowed. Show your intent to reestablish domicile in the US....looking for a place to live, making arrangements for kids to enroll in school, job seeking, listing UK home for sale, (or getting evaluation from real estate person prior to listing)...things showing you are working on arrangements to move to US.
