AOS J1 to GC

Hello,

I am a new member to this forum. I read through the guides and through previous members experiences, and I still have two unanswered questions

Brief Background:

Both wife and I are Egyptians. I am 26 (Graduated Medical School from Egypt), she is 22 (College student).

I am currently doing Cancer research in Wisconsin, and she is going to graduate from her college in September-taking summer classes.

We met through common family friend last July, we clicked together, families got to video-chat with each other.

We were engaged on the 3rd week of September.

I flew back to Cali again at the new years eve, where we got officially married the next day, and had our marriage licence. She didn't move in with me since she still have two more semesters to finish her college (First week of September).

Q1: Would not leaving together represent a problem given our situations?

I fly to visit her every 6 weeks, we video-chat daily, and talk/text all throughout the day. She should be moving with me right after she finishes her final semester.

Proofs of bond fide marriage I am planning to submit:

-Marriage certificate.

-Lots of pictures together from the engagement, marriage (held at a mosque with all community members attending), pics from our trips together.

-Affidavit of support from her father, and a lady who is a close family member.

-Joint bank account (Recent though: 1m).

Credit card statement showing our names.

(X) lease agreement/utility bills-not living together

(X) medical insurance- she is covered under her college, and I am covered through my work

(X) Car license showing same address- my license is WI, her is CA obviously

(X) Car insurance- Hers is under her fathers insurance, I don't have a car so far, planning to get one before she moves in.

Q2: I have a 2-year rule home residency requirement (212e) by mistake on my visa, and I am moving to a new job soon (July).

Advisory opinion submitted since August, 2015, no response so far- planning to submit a waiver.

Should I just wait on submitting the AOS after I get my job or should I sent the waiver request no (No objection waiver) and expect to get my EAD before I receive my new job?

I would appreciate any kind of advice/input on my situation.

You can't file AOS until you have the waiver for your 2-year HRR.

I think I wasn't clear on the second questions

I am trying to find out whether to file waiver now (NOS) followed by AOS package to get an EAD before my new job starting in July?

Or file waiver now, and wait on the AOS until I receive new job with the new J1 visa package (private funding source with no two year rule hopefully)

Like I said, you need the waiver first, in your hand. You need to file a copy of it WITH your AOS packet. Apply for it ASAP, I'm sure it takes some time to get it. Once you have it, you can apply for AOS.

I will have to disagree with you.

According to an old thread here, "No objection" waiver is the only type of waiver that you can file AOS while it is pending.

Anyway, any input regarding the first question?
