Hey VJ members please guide me my sister is here on B1b2 visa she is here with me in New York I want to sponsor her for green card I know it will take about 7 years or longer my question is that if I can get her work permit or not meanwhile staying here in US she is single not married yet 26 years old plz help me what I can do at this point

7 years? More like 15 for a sibling.

No, she cannot change status while she is in the USA. If she wants to work there, she must return home and apply for an employment visa. You will have nothing to do with that. She will be applying on her own merits. Her success with her application will depend very much on her qualifications and work experience. What is her profession?

The current wait time for a sibling petition is about 12 years, During that time your sister may come to VISIT you, but she must abide by the terms of her visa- No working No overstaying. File the petition straight away and in the meantime be thankful that your sister can come visit.

That she has a B is irrelevant

That she is in New York is irrelevant

Lot longer than 7 years.

Does she have an Employer who has petitioned her for a work v sa, if so which one?

Married or single also not relevant.

You can file her petition so she gets in the queue.

You can file the petition while she is here.

She can't stay and work on a tourist visa.

She must go back to her country and not overstay her current B2 visa. She can return and visit you when she can. Be grateful that she has that privileged while you wait for the family visa.

It will be more like 12+ years to complete.

If you are thinking about having your sister remain in US (overstay her B2 visa) and work (most likely illegally) you would be jeopardizing her immigration path.

The current wait is 12-13 years for a US citizen to petition for a sibling.

There is no way for you to get her a work permit or anything that would allow her to stay.

All you can do at this point is file the I-130. She has to go home when her I-94 expires. If she abuses her visitor visa privileges, then she puts the petition you file for her at risk.

Sorry, but there is nothing you can do to help her stay. She must return home.

I applied for my parents soon they are going to have the green cards and they I'll live here with me can they both apply for my sister and would she be able to stay here?

no, the same issue with siblings petitions, the wait is over 7 years,, she can visit, but she has to return, there is no way that she can stay here as others have said

No but if my parents would apply for her being LPR still it's that long of a procedure ? And won't be able to stay here while the process takes place

No, she cannot stay here while waiting for the petition.

Sorry, nothing that you can do.

As what other said, be thankful that she can come visit.

Once your parents are LPRs they can petition for their daughter but it would take at least 7 years (that's the current processing time and it's getting longer all the time). As stated before, there is no way for her to adjust status now. She must return home. She can apply for other visa types while the petition is running.

Hello everyone.

So it will take 12-15 years for the application to get approve if I petition my sister but she can come and visit?

How hard is it to get my sister a visitor's visa once her petition for green card has been filed?
