MTL K3 interview - April/4th

Timeline

Hello

Our K3 interview is coming up in 3 weeks. I (the USC husband) would like to get your views&comments on the following:

(1) I have not filed the 06 Fed return yet. I do have the 06 W-2 plus the full returns and transcripts for 05,04 and 03.

The 06 W-2 indicates that I have paid most of my taxes as I am a payroll worker. Would this be an issue? Should I rush to file 06?

(2) Marriage Certificate is dated Jul-06. Because the key documents should be of recent date(within 1yr), should we get a new one?

(3) Is there a significant advantage to my attending the interview? I think I'd make my wife nervous which is not what we want. If I am not there, is there a need to write a letter stating my commitment to our marriage etc..? Other than wedding + misc pictures together, what else should she take to the interview to prove her continued relationship to me?

Timeline

I believe that the cut off date for tax info is April 15th. If filing before April 15th, 2007 then your current year's taxes would be those of 2005. That being said (and assuming that I am right) you should be fine with your 2005 taxes, however, I would take your 2006 W-2's just to be on the safe side. If you choose to file before the appointment, then take that information too. It couldn't hurt.

I have no idea about the marriage certificate.

I was a K1 and did not need my fiance there. Was fine without him, though unlike you, it would have been nicer for me if he was there. Many of us have gone alone and not had an adverse reaction. However, as a K3 - does your notice ask for you to be there? If you are requested to be there, then go, if not, then I would think it's really your choice.

Feb 23 - Sent USCIS a message asking for a processing update

May 6 - Received an email response saying things were progressing normally but that waiting times might be longer

Feb 25, 26 & 28 - got emails saying that the cases had been transferred to another office, then to my local office, and then just transferred and are being processed

Mar 17 - got email, attached to one case number only, saying that my A number was changed relating to the I-130 filing

Considering tax returns are not a requirement for the I-134, whether you choose to include them is your choice. Remember at this stage you want to show the consul as much information as you can to prove your ability to sponsor and the I-134 is just one of the methods. Personally I would want the most recent information I could provide so as not to call into question my ability to sponsor a person today. The more I think about what is considered the most recent tax form, the more I believe they would consider 2006 the most recent. All tax documents have been sent to the tax payer as of Jan 31 as required by law. So not filing after that date becomes more an issue of choice than it does of ability.Again what taxes data you provide is your choice and you could assume that the w-2's would suffice.

Your marriage certificate doesnt have a validity date from xxx to xxx so whenever it was issued was when it was issued.

Any evidence you can provide to show your marriage is more than just on paper.......phone records, photos, letters/cards to each other,shared bank accounts /credit cards, beneficiary of insurance policies. Anything you can think of to make your wife feel more at ease in ensuring the adjudacator of a bonfide marriage and to ease your mind about not being there.

I dont believe there is any such thing as having too much information at this stage of the game. If you're not going to be there to fill any gaps or answer any concerns ( as I will not either) all the evidence you can provide to help your spouse in the event questions arise would be beneficial. My thinking is if they ask then she'll have it and if they dont then no big deal, at least she was ready.
