But what about this, "However, your sworn testimony on January 2016 indicates that you and your wife were already separated at the time this letter was submitted."

It seems that something was notarized April 2014, which was later received by USCIS in May 2014. Then your cousin told the USCIS officer under oath during the interview that he and his wife were already separated around the time the letter was sent. So it looks like your cousin separated from his wife anywhere from February 2014 to April-ish 2014 time frame. Bring evidence of you or your wife visiting New Jersey/Florida to a consultation with a lawyer to try to overcome the appearance that the separation happened before or shortly after your move.

First off, thanks James for your help and I appreciate you guys for your comments and support, sorry for the confusion, I should have done this myself but wasn't in the right phase of mind.

The sworn affidavit states the reason why we did not have joint credits accounts which was due to her credit score, I also attached a letter from a financial institution stating why we were not approved for a joint loan.

Update I spoke with a lawyer today and was told I had 2 options

Note: All denied I-751 cases are transferred to court proceeding and An I-751 and new I-485 cannot be processed at the same time

1. Apply for a new I-131,but not with the I-485 with my new spouse and don't respond to the NOID my case will be transferred to court proceeding, this will be faster.

2. Respond to the NOID and file an I-131 it will take another 6 months for my I-751 to be approved or denied. if approved, GREAT If denied it will go into court proceeding and there is a slight chance of success, most cases are denied in court. This will take more time.
