Yes, and it sounds like because you're expecting a refund that you an go ahead and wait for the SSN. I didn't know about this, and I want my refund ASAP, so we applied for the ITIN-- which is a whole other thing that you really don't need to mess with (it involves filing out another easy form but you either have to mail in his passport for them to review, or go to an IRS office that does ITINs and have them review it for you--- for us that was easy-peasy because the IRS office nearest me that does ITINs is walking distance from my office but that is certainly not the case with everyone).

If you are still nervous, just do this to get your return filed although the refund will be on hold until you get his ss number.

File your tax return with an ITIN applicacation, mailed into the Austin Texas ITIN office. I understand that you wont be approved for an ITIN because he is eligible, HOWEVER, the return will be filed. When you get the ss number, simply file an amended return. If it takes a long time, maybe 6 months or so, you will receive a letter from the IRS that your ITIN is disapproved and and your return is reduced. You should have the SS long before that and your amendment will supersede any back and forth. In any event your return would have been filed.

If on the other hand and you get approved for an ITIN just IRS them that you a ss and the ITIN will be canceled.

Hello!

I know I've totally dropped the ball on this by waiting till the LAST minute to file. I was going to mail in the application for my husband's ITIN with our paper taxes, HOWEVER I JUST noticed that he can't apply for an ITIN if he is eligible for a SSN. We applied for the SSN on Friday since he got his EAD, but now I don't know what to do to file our taxes. I can't apply for an extension or file my taxes without him having his SSN or ITIN. I haven't been able to get a hold of ANYONE in ANY tax office (big surprise, right?).

HELP PLEASE! I'm SUPER stressed out and not sure what to do....

In 2008 we couldnt file until August for the exact same reason. No penalty if you're due a refund. If you owe, file an extension. If you are due a refund, it doesnt matter.
