it seems to me that you think if nc's law doesn't stand than any perv would be legally allowed to walk into a bathroom and hangout there legally by claiming to be transexual. there are still loitering laws, peeping tom, assault. all the nc law did was take away the right of your friend's nephew to use the ladies room (where she would be safest) among other protections for transgendered individuals. no extra rights or just regular old rights were given or taken from sexual predators.

i'd like to see a list of what states have had laws forbidding a person to go into the opposite gender's bathroom. also would be interesting to see how many people have been charged and convicted for doing just that.

They most certainly can, do, and will continue to do so with or without this law.

Laws regarding a man/woman inside of a public toilet no matter it's particular signage 'designation' are based upon their behavior - peeping tom laws, assault, or indecent exposure only. This law restricts a person to enter a public toilet based on their genitalia, something which is not provable without invasion of privacy. It would also restrict children of the opposite sex from entering, even male or husband caregivers from entering a public women's restroom and assisting their special needs wives or children, and again restricts the ability of your nephew from entering the bathroom of their choice. Have you tried asking how they feel about it?
