Hi Everyone,

I am in the F2A worldwide category. My wife will file for me in the next 2 weeks. Looking at the current processing timelines and visa bulletin, can it be assumed that from date of submission till visa issuance, 1.5 years are realistic? Are there any reliable predictions for F2A, as it went current in 2013? Thanks and good luck!

Michael

No since past and current wait time have no bearing on future wait time. You can only guess. As you pointed out, it was current in 2013. It has also been as long as 5 years in the past. Someone guessing in 2013 thinking a visa would be quick would have been very wrong.

No, there is no such thing as a reliable forecast of waiting for a PD to become current.

Of late its been 1.5 - 2 years from application to visa approval. Things change quite a bit in these visas. Some people who applied in Sep 2013 got their visas in 3 months and some who applied just 5 days later waited for two years. Nothing is certain. We can only guesstimate

Thanks. Are there any legal visa options to "bridge" the waiting time?

As far as I understand there are following options:

B1/2 - Visa, Visa Waiver - Visiting temporarily may be permitted throughout the petition

E2-Investor Visa - possible but requires invesment.

Other reasonable options available? I think a student visa may seem difficult to achieve after I-130 has been filed and the immigration intend was declared. Thanks for suggestions.

As a German citizen, your best option is to visit on the VWP. Just be aware that if you spend too much time in the US and very little time in your home country, then CBP can determine that you are abusing the VWP to defacto live illegally in the US and revoke your VWP privilege.

So, would 3 months inside USA with Visa Waiver, and 3 months outside, than again 3 months inside - and so on till F2A visa is current be considered generally acceptable if you can proof you have savings and don`t need to work in the USA for a living? I assume being 5.5 months in the USA and 6.5 months outside should work normally if you can demonstrate still ties to your home country (lease agreement etc.)?

Since at least you can go back and forward from your country, there is a long and expensive hope, come to u.s and over stay, since your spouse already filed anf F2A in your behalf, as soon as your I-130 get approval, your priority date become current, dont file I-30 thru NVC over seas, filed I-485,adjustment of status, it's expensive but you dont have to go back to your country to wait for the process, if you over stay does not mean that you cross ilegally the bording line as an indocumented, you entered with a visa or basicly in a port entry.

How i said, if you wanna stayed with your spouse no matter how, just fallow this steps

Other wise, wait for your I-130 for an approval, up to 1-1/6 years, depending what service center will handle your case...vermont service center its the worse, then when your priority date become current, goes to NVC that will handle the case thre on as a consular process since you will have to go back to your country and fallow the process thru your embassy, after NVC... 6-12 months more

Our pd is Feb 3, 2015 and we got our case completed in 8 months... However the visa bulletin is slowing down now... so our could have been 1.5 years of waiting would probably be a little bit longer.. :(
