I am currently married to my husband who lives in Dominican Republic, we have plans in the future of moving to the dr. He was offered a job in construction here in the us in Kansas. Can he file for a work visa if he is married to an American citizen or will that cause denial of the work visa? Pleaseeeeee helpppppoo

He can't file for a work visa, the company need to file a petition for your husband basically asking the government to be allowed to hire him. They basically need to show that there are no Americans available to do the job your husband is being hired for or that he has extraordinary abilities in his field. It's a pretty difficult visa to get. The company that hired him, do they know he doesn't have authorization to work in the us?

What is the visa the EMployer is applying for? Lots of different types.

An employer must apply for a work visa and pay for it. Neither you, the US citizen, nor your husband can apply directly for a work visa. This is really not an option for a construction job.

If you want your husband to live in the US, then you apply for an immigration visa based on marriage to a US citizen. This is the easiest way for him to come to live and work in the US.

His chances kind of depend on the type of work visa; if he is highly skilled, and his employed willing to pay the $6000+ for a skiled workers visa (for example, well known architect, experienced engineer), then being married to a US citizen will have little impact. But if what he is hoping to get is a seasonal work visa, his chances would be slim as they'd be afraid he would not return home after his time on the work visa.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Work visas are not provided for construction workers. Marriage visa is the route to go.
