I-134/NOA2 Question

Hello!

I've posted this on the visajourney FB page and was directed here to post! So I hope someone here can shed some light on some questions I have:

"Hello everyone!

Here is some quick information:

K1 Visa
UK (Scotland) -> US (I'm the petitioner)
I-129F Packet sent Jan 13th
NOA2 Received April 5th

Question on I-134

So even following the visajourney website guide I'm having a little anxiety on what to do next. I've been unemployed from Oct-April (It's been super tough out there) and I recently got a job as of 2 days ago. Before that I did some contract work for a delivery service from Feb-April.

So what exactly do I submit and where do I submit this to? To the NVC? To the embassy? Do I send this information to my fiance?

From what I understood it's bank statements (of 2 years I think), taxes (2014 and 2015 be enough?), first paycheck I won't get until May 13th. I do have my offer letter I can submit. I get paid $13/hour (all I could find in this market) so hopefully that is enough over the poverty amount to be accepted. All my fiance has to do at this point is schedule the medical and interview correct? Once the NVC has processed our case of course.

Thank you for taking the time to read this and I appreciate all your input!"

Also any tips you could recommend for my Fiance when dealing with the embassy in London?

Congrats on making it this far!

You send the I134 and supporting docs to your fiancé, and she brings it to her interview. London embassy prefers a letter from your employer stating yearly salary.

You will receive further instructions from the embassy, but briefly you fiancée will need to:

- Book and attend medical

- Fill DS160 application for visa

- Pay visa fee (265 USD)

- Gather documents to bring to the interview, including her birth certificate, recent police record, the financial documents you send her and evidence of ongoing relationship between the two of you

The London embassy is an easy one - good luck :-)

If it isn't difficult, it isn't worth it.

I-134 and financial information is given by the USC to the UK fiancé. The fiancé will take the documents with them to the interview. You do not submit them to any government agency.

For starters for London, you do not need to prove the financial information in a ton of different ways. The I-134 and a tax transcript, or even better the I-134 with a signed employer letter stating how much you make and your position. Bank statements would only be if you were using savings or assets. Nich-Nick might be able to come along and give better advice on your employment status and if its enough.

Additionally, if for some reason it's not enough, if you can find a co-sponsor, only the co-sponsor would provide the I-134 and supporting financial documents. London also allows for self sponsorship if your fiancé made enough too.

Your fiancé should receive a letter from the embassy detailing what they need to do, once the NVC has passed the case on to London. They should start getting their police certificate ready, checking their birth certificate and making sure it's the long form one, going to their GP to see if they still need the required shots (you can save a lot of time, money and fuss), obtaining their vaccination history from that GP to show Knightsbridge. They will also have a DS-160 to complete and a notification of readiness form. When they receive an interview date, they can then pay for the visa online. All this must be done before the interview.

Tips: Have a read of this thread. It's very helpful for London-specific process. http://www.visajourney.com/forums/topic/474161-london-k1-a-complete-guide-do-not-post-questions-in-thread/ It will also tell you what to bring on interview day.

Don't have the fiancé leave the house to their interview without their passport :P

Don't have the fiancé get flustered at their medical. Keep calm and make sure the DS3025 has been filled out by Knightsbridge correctly. Keep that document safe. You'll need it in the US.

Don't forget/misplace their birth certificate with less than 24hrs to go, causing American fiancé to turn into a sobbing mess as they tear their house apart in a panic trying to find it.

Don't worry too much. London is very easy, and there's lots of reviews on here attesting to that fact, for peace of mind.

London won't really ask for relationship evidence. Bring it only for peace of mind.

Doesn't the medical have costs? I've heard people talking about getting shots and everything done BEFORE the interview in order to save time/money. Is that true? If she has no Police record do we still get one? Also with starting a job this soon and not being able to provide pay stubs by the time she interviews will that suffice?

Thank you again for the reply! This is great information :D

Scroll down to "what to send your fiancé after NOA2"

The guides are helpful. You don't send anything to NVC. Your fiancé takes it to the interview. If you don't meet financial requirements you will need a cosponsor who does.

Yes a medical will be done before interview. You can look in your country portal for costs. Yes a police certificate is always needed record or not. Otherwise everyone would just say they have no record.

Once NVC receives your file they will assign a case number and forward it to the embassy the embassy will contact the beneficiary (i.e. packet three) with the further instruction. This will all take several weeks. You should have a few pay stub by then.

Again this is explained in the guides flowchart I posted the link to above.

The thread will answer most of your questions but: Yes your fiancé will need a police certificate, even if they have never done anything remotely naughty or troublesome. Get this done pretty soon.

Yes the medical has a cost and the shots cost a ridiculous amount of money. Get them done at the GP for free or reduced cost - say you are immigrating or it's for travel. Some such as MMR, require a gap between injections. My husband had a three week or so gap for that, so getting it done as soon as you can will help. Make sure you get full record of vaccinations from the GP on a print out with dates listed, including any new ones obtained. The thread has the list of shots required. And your GP might tell you, you need tons of shots, but you only need the ones listed. Knightsbridge will also take your word for it that you have had chickenpox, making that vax unneeded (UK doesn't give it out anyway).

Also regarding vaccinations: I can't emphasize this thread enough http://www.visajourney.com/forums/topic/541811-another-warning-k1s-get-your-shots/page-1

The medical definetively has costs! Don't know the spesific amount for UK, but approx 300 USD I guess. She should update her shots and keep her vaccination records before the medical. The medical needs to be completed at the embassy appointed panel physician (Knightsbridge) before the embassy interview. She will receive further information about this.

She definetively needs her police record, the point is to show that it is blank :-) Also, if she has lived in any other country for longer than 6 months since the age of 16, she needs the police record from there as well.

You should be fine with a letter from the employer as long as you meet the required yearly income (this is for LONDON embassy only, as a warning to other members).

Also, please update your timeline when you get the chance. I'm guessing your receipt number is WAC....? Then your case was sent directly to CSC from the Texas lockbox. Texas service center (completely separate from the lockbox) haven't been handling K1 petitions in the last year :-) I'm sorry, this has become my pet peeve since there's a lot of confusion about this out there :-)

If it isn't difficult, it isn't worth it.

Have you looked at self sponsorship?

Hello godzilla. I am going to refute a few things that are not correct for a London interview.

You will receive further instructions from the embassy, but briefly you fiancée will need to:

- Pay visa fee (265 USD)

- Gather documents to bring to the interview.............and evidence of ongoing relationship between the two of you

Don't pay the fee until you have received your interview letter assigning your date.

You do not need to prove your relationship with any documentation, photos, etc. They will not look at it.

http://www.visajourney.com/content/k1guide

Scroll down to "what to send your fiancé after NOA2"

That list is serious over-kill.

For a London interview you need none of that list except sending the I-134 and a letter from your employer since it's a new job. If you have pay stubs by interview day, you can scan and email for her to print and take as backup to the employer letter. That will be enough. Make sure the employer says a yearly income or at least something that can be calculated like $/per hour and hrs/per week.

She definetively needs her police record, the point is to show that it is blank :-) Also, if she has lived in any other country for longer than 6 months since the age of 16, she needs the police record from there as well.

It won't be blank. You are looking for the words "no trace" on the police certificate. If it says "no live trace", there is a hidden conviction or caution on record so she should order a Subject Access Report as well. Yes a caution counts.

Her instructions from the embassy are found on the web. Read every word and follow every link so she knows the LONDON procedure. Each consulate does things differently. https://uk.usembassy.gov/visas/fiancee-2/applying-for-the-visa/

Thanks for the corrections. I forgot to mention that the list was not in chronological order, since I know the order of actions varies from embassy to embassy. I also meant blank as in "blank/non-existent history".

Are you sure that nobody at the embassy in London are asked for relationship evidence though? I know it's rare, but I wouldn't want be the one standing there with nothing if they should ask. I'm asking out of curiosity, so that I may be better informed in the future :-)

I have never read of anybody being refused for relationship evidence, and I have read UK posts daily for eight years. I have read many hundreds who said they weren't asked. I recall AnnaGrant making the officer look at photos of her proposal because she thought it was such an adorable story, but the officer did not ask to see them. He only asked "how did your fiancé propose?" And she says let me show you. Another guy from about four years ago posted that he was asked for evidence, however it was his 18 yr old son applying for him. The rest of his story revealed to me in a PM was very shady indeed...years of overstay in the US, leaving, getting back in and overstaying again, non-British born, questionable and undocumented name changes from a Middle Eastern name to a very British sounding name, and very questionable address discrepancies for the petitioner in multiple states. So he was asked for a lot of evidence, but not in the way his thread sounded, which was more like "London was very difficult and asked me for a lot of evidence." Darn right they did, but it wasn't for Skype talk, engagement receipts, or love messages.

Edit: I have just now read Boiler say he was asked for a photo, but I think his first rodeo was 2007 or earlier if I recall. Prior to my joining.
