AFFIDAVIT OF SUPPORT QUESTION FOR IR5 ADJUSTMENT OF STATUS

Hi guys,

i have some questions right now. Hope you guys could help me out.

I file i-130 petitions for my parents. They are in China right now, but they both have visitor visas. They came here before once.

Right now I paid IV FEES and AOS fees for my parents. But when it comes to affidavit of support, I encounter the problem.

My househould size is 4. My husband sponsored his mother 3 years ago.

Right now, my income is not enough.

For year 2013, i was a student, i dont have income. My household income is $18,000.

Year 2014, I had part-time, but my income is less than $5,000. My husband just started his business, his income is $28,000. But his business is in loss. So the adjusted income for my household is $8,000.

Year 2015, I made $20,000. My husband made $30,000. And his business is much better. He earned $6,000. So the household income is $56,000.

Year 2016, I just got a nice job. $25 PER HOUR. So i could make $35,000 at least this year. And i think my husband could make $ 40,000 this year. So we might have $75,000 income.

So my question is , I know if my parents have their interview in China, Consulate in Guangzhou will need my 3 years tax return transcript, my income is not enough to cover.

But if they come to the United States and do the adjustment of status, probably the visa office in Boston only need one year tax return transcript. Is that correct? If that is the case, my household income is enough to support my parents.

So what do you guys think, ask my parents to come here for adjustment of status, or stay in china for the interview?

Whether you attach one year or three years of tax return doesn't affect whether you meet the requirements, which is based on your current income.

Your household size should be 3 for each of your parents (you, your husband, and the sponsored immigrant) unless you have a dependent child or something.

They should not enter the US with a visitor visa with preconceived intent to file Adjustment of Status during that trip.

But i just heard that Guangzhou Consulate is very strictly on the income requirement. Even though my current income is good enough, but I am afraid Guangzhou Consulate will still ask me for the joint sponsor because of my 2013 and 2014 income is insufficient. Will that be matter?
