Three months residence same state

Hello,

My wife and I were married Feb 2, 2013 and she received her green card May 7, 2013. We had been living in Washington State the entire time but a new job caused me to relocate to a different state on Jan 29, 2016 and notified USCIS within 10 days on Feb 5, 2016 . We were within days of submitting the citizenship packet on Feb 7, 2016 because that is 90 days prior to the issuance of the green card but since we were moving we decided to wait and send when we were three months in the new state.

We will fulfil the three year requirement in two weeks and want to be certain we will not be rejected. What date should I send the application and what documentation do I send to show we have been here three months?

Do I show the lease of our new residence showing we were here January 29th?

Do I include the change of address confirmation email on February 5th?

I do not want to be rejected and have to apply again.

Any help is appreciated.

Since applicants don't usually send proof of how long they've lived in a state with their applications, those who fail to meet the 3 month state residency requirement are usually denied at the interview. In a few cases, the initial receiving center notices that the dates in the Adress History section of the application aren't sufficient and if they do they'll send back the application. Unfortunately, most people in this situation make it to the interview before denial.

At the interview they'll want to see your state ID. Very cautious applicants wait until they've had a new state ID for 3 months, but a lease is almost always sufficient proof of when you started living there. You should bring this to the interview, but you can also include a copy with the application if you want to be on the safe side. Employment letter showing a start date, changes in insurance coverage, etc are extra forms of proof.

USCIS doesn't ask for anything too onerous here; I personally think a lease would be sufficient.

You can send your application 3 months after Jan 29, or to be more cautious 3 months after Feb 5, or to be more cautious 3 months after your new state ID issue date. I don't think your application will be rejected if you mail it on any of these dates (based on what you've said). If you're worried, take the most cautious approach.

The 90 day before is not a requirement. I am not quite sure why everyone and their mother tries to time that.

Since u moved end of jan, i'd say send sometime in mid-may and u wont have to worry about any dates.

That being said, try and get your new license and/or lease document so that the date can be used as evidence of 3 month stay.

2006 - Entered US on F-1
2009 - COS to H-1
2011 - Married USC

Conditional GC Process:
04/2012 - Concurrent I-130 petition / I-485 AOS / I-765 EAD / I-131 AP sent
35 days to biometrics, 73 days to EAD/AP combo card, 85 days to interview, 96 days to Conditional Green Card

04/2014 - Eligible for ROC

06/2014 - I-751 package filing joint with spouse sent

5 days to extension,37 days to biometrics, 172 days to CSC transfer, 247 days to Green Card

04/2015 - Eligible for Citizenship

09/2015 - N-400 package filing on basis of USC spouse sent

29 days to biometrics, 105 days to interview, 147 days to oath and US citizenship

~ 9 years and 6 months from first entry to US citizenship
