Filing is about a year out, What services did you use for mail and documents into English?

I have been reading this site for awhile now, and just started my account. My boyfriend and I are thinking about getting married and trying to see if we should try or wait for a k-1, if anything we are about 1 year out from filing, due to him being married with a child, and me currently not having a job, but I do have a few 2nd interviews with companies this week. We have been with each other for about 8 months now, and I'm trying to collect everything now so when his divorce happens he can send me everything and its all ready to go, or seeing if we should just switch to being friends because of the laws of getting a k-1 for us.

My boyfriend is currently in the USA as a J-1, leaves in 7 months, visa from Russia with no 2 year, but sadly is still married with a child. :( They have been apart for at least a year before he came here on his visa. Last I knew of both parties want to get a divorce, but since they have a child together it will take longer, I know they own a something over there and there is debt. From the file date, does anyone know how long this divorce could take if everyone agrees on everything? I read somewhere that if one party don't agree there is a 3 month waiting period. I'm really hoping that his soon to be ex-wife can file the papers while he is aboard so when he is back in Russia they can get it done within a month or something when he gets there. She was thinking of filing for the divorce back in February.

When he goes back to Russia, and I don't meet the income requirements for support for the k-1, can I have a sponsor or joint or cosponsor? He has a friend here in the USA that could do it, but that friend just became a Green Card holder in August 2015, and has a well paying job that can cover his friends household and my boyfriend, his child will be staying with the mother. I currently live at my mother's, whom receives money from my fathers retirement, pension from the company my dad worked at and the life insurance monthly income. She is unable to work due to disabilities. Sadly my father passed away in December, we are trying to get my mother the money she needs to live. I had lost my good paying job in January, before hand I worked part time, which is how I met him <3. Which barely gets me at the 100% poverty guidelines. Right now my goal is to get any job, even part time that will allow my mother and I get meet the 125% with 3 people. (Her, Him and I. for when we do the AoS) I know we can use assists, such as the house and any money in the saving account, I'm hoping more money in my bank account can help off set of not able to met the guidelines when the AoS comes into play with out using the house. I rather have his friend do the income of support instead of my mother. We have a few other people we could use, but I don't know their information. Just looking at all we options so this process can go smooth. We will be living at my mother's till he can get his career back up in the USA.

For sending the paperwork between him and I, what mail services did you use? I was looking at Fedex and their prices were over 200$(for 5 pounds in a small box) while USPS was much more affordable 73$ or so for a large box up to 20 pounds.I know he will need to mail me his divorce decree and other documents, before I can even file for us. So what Russia mailing service would someone suggest? Also I think he needs the information translated into English, anyone suggest a place to go to get that taken care of? Or can I have him send the documents in Russian and I can take care of that here? I would assume that in Russia it would be tons cheaper.

And I already know this answer, I know he can come and visit me or me see him while the divorce is going and the filing process is happening. But the one thing I am afraid of is his company that he is currently working with wants to send him back to the USA after his j-1 program is done and this process will effect it. How soon can he get a B1/B2 visa, for any business trips or to just visit? I understand if no one knows this answer I have been trying to search about it online and can't seem to find a direct reply. The thought of him not being in my arms for nearly a year scares me. I do have plans on visiting him and I know the steps on what to do for that.

We just want to make sure we do everything legally and know what we have to face so there are no "hiccups" that will prolong us from being with each other.

Thank you for your replies and help.

Many folks from Russia get K-1s all the time. You can too.

That is a must and you are well advised to wait until that is final.

When he goes back to Russia, and I don't meet the income requirements for support for the k-1, can I have a sponsor or joint or cosponsor?

Yes but if your income at the time of interview is sufficient, no need for one.

He has a friend here in the USA that could do it, but that friend just became a Green Card holder in August 2015

Cosponsor must be a USC.

Just looking at all we options so this process can go smooth.

Any USC can be a cosponsor.

We will be living at my mother's till he can get his career back up in the USA.

Fine

For sending the paperwork between him and I, what mail services did you use? So what Russia mailing service would someone suggest?

I only used FedEx since I wanted confirmation of delivery.

Also I think he needs the information translated into English, anyone suggest a place to go to get that taken care of? Or can I have him send the documents in Russian and I can take care of that here?

Yes if you can. You can and will insert a page certifying that you are proficient and have translated the documents accurately. No special certifications required.

I would assume that in Russia it would be tons cheaper.

You can do it for free.

And I already know this answer, I know he can come and visit me or me see him while the divorce is going and the filing process is happening. But the one thing I am afraid of is his company that he is currently working with wants to send him back to the USA after his j-1 program is done and this process will effect it. You said your boyfriend is currently in the US on J-1, this is a NIV, to my knowledge only US Citizens can file for K-1. He needs to go through Naturalization which can take some time. Otherwise he will need to wait until he has LPR status, and you will need to marry and file CR1.

I guess I wasn't clear, I am the USC that will be doing the filing for the K-1. And I understand that I need to wait for the divorce is final before him and I even file for the k-1 since i need the paper work. My question was about if she(his soon to be ex wife finally legally) is able to file for the divorce while he is over here or does he have to be over in Russia at the start.

For the i-864 anyone can sign the document as long they are a LPR (Greencard holder) or a USC. I'm trying to get more information on the i-134 requirements of whom gets to sign it. It does look like there is a spot for someone that is a LPR on the form. Which I guess according to the website alllaw.com says a lpr can sign it, but I'm trying to find it on the government site about it to confirm.

I was offered a job yesterday which hopes goes well for me so that I don't need a cosponsor... but incase it doesn't, I just want to know my options. The job will pay way above the 125% mark.
