SSN#, GREEN CARD, AOS

Let me start by saying the following situation is not one that I am personally in, and that is the truth.

There is a Filipino who is the wife of an American man. She has been here for two years now, but she is kept at home, She does not have a SSN#, she does not have a green card, she does not have any required ID. She is not allowed to leave the home for any reason unless she is with him.

What specific rights does she have? and who do she contact about her situation?

Sounds like she's being abused, in which case she should report it to the police.

How did she get to the US? K1, CR1, overstayed tourist visa etc?

Her then petitioner, now husband brought her here back in 2014 on a K-1 fiance Visa Petition.

If he knows but refuses to, it's possibly a vawa case.

If she is really a prisoner in her own home then she should call the police. 911.

Agree 911 / green card should have come to the address so he probably has it / also he would have to have SS number for her to claim her on income taxes / and get health insurance, etc for her / since she seems to be able to talk to u, call 911 yourself and report the abuse / tell the police they must get her away from him to talk and question her as many women are so afraid of the husband they will not answer police in front of husband or at all / signs of abuse are still visable to a qualified investigator / i am not putting any women down but many from foreign countries think they must obey the husband / BS in the US / this woman can also tell her doctor or clergy / any number of people are out there to help

Ok so came on a k-1 in 2014 and presumably got married within the 90 days? Did they adjust status after marriage? I mean does she have a green card it's just that she doesn't physically have it or is she just out of status? I'm with NRL, if the husband's deliberately preventing her from adjusting status and getting green card and SSN, she could adjust under VAWA. She should report the abuse to the police and look into women shelters.

Does she want to get out of marriage? Assuming she must have told you guys something about all this?

She is married to a USC & sounds like she is being abused. Possible VAWA case. If she filed for VAWA & was approved, she'd get a GC. First though she has to get away.

They have not completed the AOS: The man is in total control of everything.

They will out in the countryside, no close by neighbors. So he does what does. Left for the weekend, but leave she and her first grade daughter at home with no phone. He tells her that if she needs anything to email him. What if there is an emergency? his response, was "you can email 911 if you have an emergency. I say, How stupid is that????

You can call 911 and report the case.

If she have access to email, she should email this and report her situation: 1343actionline@cfo.gov.ph. With this, PH Embassy nearest her will contact her and tap local resources to help her.

She can get help that she need from the Phil Embassy nearest her.

She has no home phone, she has no cell phone. As silly as this story is, It is not a simple one.
