I used to have k1.Now i have temporary green card( 2 years) which expires on July 29. We got married in march 2014. For reasons of privacy my husband filing his Tax return as single.

Thanks for the clarification. You will definitely need to amend taxes as others have said. Your initial evidence is weak even with included joint tax returns. Many an RFE have been sent at the ROC stage because of weak evidence.

some people requests to be deducted as "single" on their tax form (W4) so that they will get more refund (its like forced savings), rather than being surprised with a tax due comes tax time. but comes filing time, they will change it to "married filing jointly".

Well, you came here asking for advice, and are being adviced by many experienced members that your evidence IS weak. It's up to you how you deal with it obviously, but don't be surprised if you get and RFE on your ROC application.

Vacations and pictures are good, but they'll be primarily looking for evidence of co-dependency and marital trust.

Your husband also has an issue with the IRS for filing his taxes wrong.

If it isn't difficult, it isn't worth it.

One experienced member and now you. So whats missing in my list of proof?No kids like many other couples without kids.No insurance, i believe a lot of americans don't have insurance. All the utilities already included in rent and we have lease with our names on it.So whats exactly missing?

What is missing: co-mingling of finances and proof of bona fide marital union

Some suggestions:

- Joint car ownership and/or insurance

- Joint insurance

- Bills in both your names (phone, utilities, whatever)

- Bank statements for joint accounts

- Credit card statements for joint cards

- Tax return (!)

- Memberships

Other things:

- Letters addressed to you showing the same address

- Wills

- Power of attorney for each other

Good luck

If it isn't difficult, it isn't worth it.

Affidavits and pictures are not primary evidence to show that you are co-mingling your financial assets and obligations which is the main thing the IOs care about when reviewing your documents. Does your husband have you on his health insurance plan? Are you a beneficiary on his retirement savings such as 401K? Tax returns are typically one of the best evidences, but since your husband decided to file it incorrectly, it may raise questions and potentially cause you to receive a RFE.
