Marriage contract for DCF

Hello guys. Me and my husband is married at USA. I went there under k1 visa, got married and filed for Adjustment of status. 20 days before my green card interview I withdraw my application. Me my husband and my son move back here at Philippines. Now my question is, can we file DCF using our marriage contract from USA? I didn't do report of marriage by the way.

Any input much appreciated. Thank you.

You mean your marriage certificate? ... Then yes you can use that to file since it proof you guys are married.

You checked if they have DCF in PI? (I don't know)

Just checked, there is a USCIS field office so yes DCF should be available.

OP confirm that your husband meets the residency requirements for DCF.

I read that in Philippines you need to register your marriage there also. So your marriage has to be official there too. You are still a Philippine citizen so you need to register you marriage there. Your embassy has to recognize it there and here.

Your husband must meet the residency requirements in the Philippines to qualify for DCF. He must be residing in the Philippines for a period of 6 months and has proof other than his passport stamp. You can use of your marriage certificate from the US but I think you need to get it "authenticated" by either the DFA or NSO. I'm not really sure about that process though.

My wife and I agree that you'll need to report your marriage here at NSO so you can get all the other docs needed to file DCF. The marriage certificate itself should be fine but guessing you took his name you'll need to up-date your docs here.

Another question hopefully somebody can answer it. is it possible to renew my passport under married name at the same time i filed the Report of marriage at dfa manila?

If renewing your passport here and you'd like to use your husband's last name, you have to attend the CFO seminar first. That is one of the requirements for passport renewal

I have CFO certificate from k1 process before. They told me that's lifetime certificate. I still have my cfo certificate. I decided not to file Report of marriage at DFA manila.seems so complicated since we got married over a year.

Our plan is to file DCF.. but someone told me once my husband left the country, we're back to zero of residency requirements. My husband stayed here at PH for 7 months but just left the country this week and will be back here after 2 months. So if it's true that we're back to zero for residency requirements, maybe he will do the I-130 petition at USA ??
