From Nepal, dont have birth certificate to file k-1

Hi

I m from Nepal and we r going to do k1.when we was gathering documents i found that i dont ve birth certificate from the place i was born at i.e. "Tamlichha VDC" (born in 1988 udayapur district). but i already made citizenship from my father (when i was 18) so there is written the the birth place of my father i.e. "Salthumka VDC". Salthumka vdc is the former name of Tamlichha vdc while in Panchayat time. But when i made my citizenship in 2006, there was not sulthumka vdc anymore eventhough the officer wrote down the former name of place which i think it was their mistake.

And now i m trying to get affidavit of my birth from "Tamlichha VDC" but the name doesnt match with that of my citizenship. and i tried to change the name of my birth place in the citizenship but CDO Office said once it is made it cant be changed. and also my so many other important documents like prior marriage certificate and divorce paper, child custodian etc. there is metioned "salthumka vdc" is my birth place. so i dont think it ll be good idea changing the citizenship and all other documents.

i m very frustated going through all these problems.no idea where to start and which documents to fix. already been 3 weeks stucked in my hometown while trying to fix these problems going door to door each officers. but one officer says different things and other says different things. seems like they r not sure how to do their own work in nepal. so, i would like to ask these questions if u ve also gone through it. PLEASE HELP!!!

2) how can i prove that i made citizenship from my dad's citizenship and salthumka is the former name of tamlichha?

3) do i need to show my citizenship at the time of interview?

4) which name of birth place should i write while filing for k1 ? one in affidavit of birth or in citizenship?

5)do i need marriage certificare to my prior spouse in the interview?

6) my child is of 5 years. and i made his birth certificate last year. does that birth certificate work in the interview or do i need to make affidavit of his birth too?

You don't need you birth certificate to file the I-129F if you are the beneficiary. It will be needed for the interview, but if you can't get it then try and write the embassy and see what else they would see. I know on the e-mail we get in my country there was something about if we didn't have our birth certificate but it could be different for your country.

Your sons won't be needed either until the interview.

Since you never had a birth certificate, either you can ask for a certified birth certificate from your VDC or have them give you a statement in their VDC letterpad stating that no record of birth exist in their file.

Affidavit of birth should be made from people who were present at the time of your birth or who are aware of your birth (not from VDC local registrar). Make affidavits from your parents and/or your uncles who were present during your birth time.

2) how can i prove that i made citizenship from my dad's citizenship and salthumka is the former name of tamlichha?

Citizenship card is useless for visa processing. Passport will have your district (Udaypur) as your place of birth.

3) do i need to show my citizenship at the time of interview? NO

4) which name of birth place should i write while filing for k1 ? one in affidavit of birth or in citizenship? Mention the district as shown on the Passport.

5)do i need marriage certificare to my prior spouse in the interview? NO, you'll need the Divorce certificate.

6) my child is of 5 years. and i made his birth certificate last year. does that birth certificate work in the interview or do i need to make affidavit of his birth too? that birth certificate along with the affidavit of birth from you and your wife will work.

I would like to have all papers ready before we file for k1 so that we dont ve to rush later on. Birth certificate of my child should of made within one year of his born? I have seen somewhere it was written that.

I still have some more questions-

1) As you said i can make affidavit of birth from my parents and relatives, dont i need to go vdc or cdo office? Or how can i make it? Affidavit of birth is to be made for people who know about your birth (VDC or CDO will have no idea about your birth). Make it from your parents or close relatives. See the attached sample. It doesn't have to be exactly like that. If you google Affidavit of birth, you will find loads of samples. You can make one in Nepali and later on have it translated OR if you parents or uncles know English, you can make those in English.

2)What is affidavit of birth called in nepali? I think it's called "Sapath Patra". You don't have to make in Nepali, you can make it in English if the one signing on it knows English.

3)if i got my affidavit of birh then also do i need statement of no record of birth exist in their file? Yes you need the statement of No Record from VDC in their letter pad. Affidavit of Birth is needed because because there is no birth certificate.

4)my child is of 5 years. and i made his birth certificate last year. does that birth certificate work in the interview or do i need to make affidavit of his birth too? I m worried becoz i have seen in the embassy site that birth certificate should of made within one year of birth and in long form. It is better to make the affidavit of his birth too just in case.

I really appreciate you taking time to response. Now i m so much relaxed. Before i didnt know how to do all these paper works. And esp. I was very confused how to fix my citizenship issues. As u said i dont need citizenship in the whole k1 visa process and i can write the name of district as city of my birth that huge load off my back. Thank u very much once again☺

Just letting you know that if you are submitting no record of birth statement, you might have to provide a lil bit more evidences that just the affidavits. Some of them could be: copy of passport showing birth date and place, any school records or certificates showing date of birth/parents name/birth place, or any other things you have in your possession that lists your birth data.

Just letting you know that if you are submitting no record of birth statement, you might have to provide a lil bit more evidences that just the affidavits. Some of them could be: copy of passport showing birth date and place, any school records or certificates showing date of birth/parents name/birth place, or any other things you have in your possession that lists your birth data.

Birth certificates and/or no record of birth certificates have to be made from VDC/municipality you were born in. Affidavits made from your parents or your close relatives can be notarized by any Notary Public and not necessarily in front of VDC sachib. There are lots of Notary Public in Nepal to notarize such things.

Birth certificates and/or no record of birth certificates have to be made from VDC/municipality you were born in. Affidavits made from your parents or your close relatives can be notarized by any Notary Public and not necessarily in front of VDC sachib. There are lots of Notary Public in Nepal to notarize such things.

If i made affidavit in nepali first and then notarize. Do they ve to sign in the notarized one also?
