So , it's been no secret how I feel about the Montreal Consulate and their slowazzed methods but after reading through some of the AOS posts, Im a lil bit nervous. Are there any stats around covering how many actual Canadians have been hung up by FBI namechecks? I'm really trying to weigh the options here. My rational mind says go to Montreal for the CR-1 but my emotional mind says "####### are u nuts". If I could somehow weigh the odds of my husband being held up in namecheck hell, I could feel better about which to choose.

So far the progress that was made with the I-130 has not been promising in helping me make a choice in that direction. After approval of the I-130 it took a month for it to be documented at the NVC. The recording at the NVC said the choice of agent forms and AOS bill were sent on the 25th of Dec.......2 weeks later my husband received his package and 3 weeks I got mine......not very promising.Oh and dont even suggest Jame's shortcut .........Ive read and reread the instructions for doing barcodaes and my brain starts to bleed........apparently Im just not smart enough

So Im appealing to all of you, my Canadian compadres, for statistics. Have there been any AOS namecheck hold ups reported out of Canada? If so for how long?

I’m not in a name check as far as I know but I do have a question that maybe will help.

When you file for AOS does that mean they stop processing your I-130? I kinda assumed that’s what happens but if not then you can file AOS and see which gets approved first.

I haven’t heard anything about my I-130 though and I applied in 2005.

CutienPurg, you are reading my mind.

It was always my intension to go back to Montreal for my IR-1 interview since it is within driving distance of where I will be in the US, but for the reasons you state above (and the fact that my effing I-130 hasn't been touched since the issuance of the NOA1 last friggin' August!) I am seriously considering (and dreading) going the AOS route.

Anyway, thanks for posting this. I hope those 'in the know' will respond.

To be honest with you Im not really sure what happens to the I-130 once AOS has been filed. The approval notice for the I-130 is required for filing the I-485 when adjusting from k-3 and it's suggested you should contact the NVC to inform them you're opting for AOS.If I had to take a guess, I'd have to say they do stop processing the I-130 at the NVC.

What they do with it? Your guess is as good as mine.

If my I-130 wasn't retained, I would have followed it through NVC and go to Montreal for the interview (still would have followed through the K3 too). Seems like NVC is much more efficient than USCIS.

if you AOS in the States, the NVC sends your approved I-130 to the district office where your AOS is.

No idea on "odds" of Canadians who get stuck in endless background checks. I don't recall any at all really.

Ok.......Ive made a decision. Whether it be wrong or right good or bad ........I think consular processing is the way to go. I have to restate for my own personal satisfaction that I hate Montreal and the notion of dealing with the backlog and backward pace gives me pause BUT.....Ive considered the worst case scenario for both options and even at its worst Montreal wont be as bad as the open ended list of what could possibly go wrong with AOS. We're at the end of the list of people who have been given the unique opportunity to choose consular processing without the added step and headache of filing an I-824 ,so we should take advantage of that.

So next week we'll start that process < sigh> Heres hoping I've chosen the right one. :unsure:
