Hi,

I am a US citizen through naturalization, I have a small business in New York, registered as S-Coporation for over 5 years now. It's a one person company that I opened for my consulting jobs. It's been active and I have legitimate taxes record through out these years. I am wondering if I could hire or sponsor a Spanish national for any type of work visas or better a permanent resident. He has a high profile experience in Research and Development lab in an American technology firm in Europe, and a PhD degree. I did a little research on USCIS web site and found this document. I am not quite understand it yet and this is a very initial step I'm taking. Could anyone with specialty in this area please explain to me regarding different options I may have?

This is the document I found on USCIS web site:

Thank you very much for any help, greatly appreciate.

Shari

It is highly advised to have an attorney versed in immigration law, and knowledge of employment visa's on retainer for the process. I have yet to find a company to date that has not used a lawyer to facilitate the Work Visa process for them. The process is lengthy and expensive.

you will have to prove that there is not currently an American with the same qualitfactions that could do the job

you will need a lawyer / VW is in my area and they use an attorney to fill postions with some foreigners / mostly because the foreign emplyee not only has specials skills but speaks multiple languages. If you do business on an international level that is one of the things that may be in your favor

an attorney specializing in work visas is extremely expensive / my neighbor is here on work visa with his wife / /alone the attorney for his work visa was $15,000 / remember and ask about renewing the visa every 3 years costing another attorney fee as seen in following post

A foreign worker with an H-1B visa can stay in the U.S. for a maximum of six years (plus extensions in certain circumstances, discussed below). The H-1B visa is initially valid for three years and can then be extended for another three years. At the expiration of the maximum period of stay, the foreign worker must either leave the U.S. or obtain a different status (such as an F-1 student or O-1 "extraordinary ability" worker).
