Is expedite possible due to NVC error?

My scan date at the NVC was February 16 of this year. At the 45 days, my application still hadn't been looked at so the representative recommended a supervisor review to look into why and advised that could take an additional 45 days.

I called at 55 days for an update, and I was told that actually my application actually had been reviewed over a month ago on March 11th, but whoever reviewed it didn't update the system regarding the decision so it has to be reviewed again. I've been set back over a month already and my case still hasn't been updated 60 days later.

Due to this setback being an NVC error, do I have grounds to expedite the interview date? If so, how would I go about doing that?

Unfortunately I have never heard of that though. Reasons for expedition are usually medical/financial hardships etc. (I don't think) NVC won't expedite your case due to their own errors because that's what they do everyday- making errors. I was stuck at NVC forever and they kept sending me checklists saying that I hadn't submitted this and that (surely we did). And overtime we called they literally gave us TOTALLY different answers (e.g one would tell us to sit and wait because we were good, nothing was missing or needed from us; and then the other would tell us that something's wrong with my birth certificate etc etc).

You really need a lot of luck in this game. Some got efficient staff reviewing their cases and they got CC very soon and some (like me) are just not so lucky.
Yet, you may call and ask and give it a try. Asking for an expedition wouldn't hinder/slow down your application anyway. Good luck :-)

As far as I am aware an expedite is only granted on grounds of medical or military reasons.

Whist one would justifiably expect that an organisation that had made a mistake and caused inconvenience to a customer should go out of their way to make amends and reduce any further inconvenience to the customer, it doesn't work that way with government departments. They are a law unto themselves.

If this was a restaurant and the kitchen lost your order, causing you to wait over an hour for your meal, you'd never eat there again. You'd complain to the manger, maybe even get a reduction on your bill. But the only way to express our dissatisfaction with a government department is to "rock the boat" and many are reluctant ti do that for obvious reasons. I certainly wouldn't want to be labelled a "problem client" when someone's finger is hovering over the button that will approve our case. One thing government departments do bit take kindly to is criticism.

Unfortunately for us, there is only one place and one way to get our visas. We have no choice in the matter. And they are well aware of that.

Interview: December 6, 2016 London

N-400 filed: September 30, 2019

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
