Ok I am really not sure what to do. I called the Visa center today to check the status of the CR1 and the lady said it was approved on March 8th. Well my husband has his K3 interview on the 19th which is this monday. I know that Amman won't have his CR1 case by this Monday so we won't be able to ask them to change the interview type.

Since we have this interview do we just take this one and then fiel for adjustment of status once he gets here. (Positive mojo) He will be granted his visa.

I was under the impression that he still has to have the I130 approved and completed, not really sure. I have just been guided along the waywith so much help and support for VJ I just comply and I am here now. :help::help::help:

His I-130 does not need to be approved/completed to interview for an approved K3.

We used to be able to change the interview type, as well as the consulate/embassy depending on how far along the I-130 is can reschedule the K3 interview in exchange for the I-130 interview. However, the USCIS changed the process and I don't think it has completely caught up to all consulates yet.

The new process is if there is a K3 in the works, it is approved and moves forward, they want you to interview and even enter this country on the K3, then use the existing I-130 to adjust status here in the states. As far as I know, the new process is this:

  • Once a K3 has been approved it is forwarded to the NVC and then to the consulate/embassy for an interview.
  • The I-130 will continue processing here until approval, and even go to the NVC to complete processing.
  • The I-130 is held at this stage until the beneficiary adjusts their status, then the I-130 is used for this purpose.

I remember seeing someone posted a link to this new process, but I can't find it now. Anyway, your husband will be fine, the K3 interview is Monday, there is nothing you can do right now. The I-130 does not need to be approved or completed for him to interview and them issue a K3 visa. :thumbs:

Thank you an di am so glad that our interview is Monday and I know that the I-130 is case complete so I can only pray that th eEmbassy in Amman will approve everything as the NVC has already done. It seems that Amman has been giving them the visas right now and I can only pray they will continue to do so and that it is not the luck of the draw as sometimes I think that is what is really going on.
