I have argue with my husband on form I864. His parents fill joint sponsor for my AOS. His mum quit the job last year. So I think the current income for this joint sponsor should only count his dad income. But he thinks ' current income should be same with year 2015', so we should fill same number as 2015 tax return. He said this is how american speaks english, 'current does not mean now, means a period time to now' .

Also his mum now have unemployment benefit. i am not sure if i should fill it as her income. Thanks

hi

your husband is incorrect

current means 2016, if she is to combine income with her husband, she has to be currently working, she would estimate how much income she would get by Dec 31st of this current year, she has latest tax which would be 2015 as of next week, but she now needs income or assets for this year

they want to know if she could cover you once you become a LPR

she needs to be working or have assets to cover you in case you become a public charge,

It doesn't have anything to do with any year. Current means right now, i.e. at this moment. It's the annual salary of the jobs the sponsor has at this moment. If the sponsor started a job yesterday then that counts in the current income, regardless of whether they have been paid or which part of the year this is. If the sponsor quit a job yesterday then that doesn't count, no matter how much they earned in that job this year.

Note that each person's current income is separate. There is only one joint sponsor (either his dad or his mom; it only makes sense for it to be his dad) who fills out I-864. If the sponsor (his dad)'s income by itself is insufficient then they may also include the income from household members (e.g. his mom), who would then have to fill out I-864A.
