Cartels war - safety issues for children. qualify for asylum? options?

Hi there, my parents in law (LPR) are currently in the US. They currently have two children in Mexico. The parents in the US making money to be able to bring both their kids to the US.

They are both trying as hard as possible to support their kids financially. They both live alone, one is 20 and the other one is 11 years old. However, the city in which they live is currently undergoing a war between cartels and a lot of innocent people is getting wounded, killed, kidnapped, raped, etc.

The parents are worry, obviously. They are planning to for this month to submit an i130 for the 11 year old. The 20 year old would be 21 years old, so they don't think its worth apply for her at the moment since she will aged out anyways and she would not make it under the CSPA program eitherway. They're planning to apply for the 20 year old in a few more months when they can save more money for the application.

Can the 20 year old apply for asylum to move the states to be safe, does she qualify?

or can also the 11 year old do the asylum instead of the i130?

Is it worth submitting the i130 for the 20 year old?

Is there an option for expedited processing since they're alone?

any other options?

If they are so worried about the welfare of their children, is there a possibility to move them to a safer city? It is not likely that the Permanent Residence application moves as fast as the urgency of your post suggests... I would say it is best for them to be relocated to another area of the country, even if they do decide to pursue the immigration for the younger one.

As for the older one and the asylum claim... it is tough. Does she have any proof of direct threats or previous harm? Police reports, psychological evaluations, etc.? I do not think that an asylum claim based on the terrible violence that our country suffers is enough to grant an approval. If that were the case, half or more of our population would already be in queue for that particular process.

I suggest you to Google asylum claims and frivolous applications. I am not saying yours is, but just be informed that there are serious penalties for filing something like that when in reality your relatives are suffering the same and sadly common insecurity that everyone else is subject to in the area they live in.

My advice if you do decide to follow through with it:

Be thorough, complete and totally honest when filing for asylum.
Be aware that having your case denied would not be the worst outcome if you are found to have filed a frivolous application.

I really do wish you the best of luck so your family can be reunited soon. Must be tough to leave a child behind.

People from war torn countries rarely get asylum. If they feel like they are in danger the US government will just ask why they can;t move to a safer neighborhood. Which they could and should easily do.

Have your family arrange to have then moved to a safer place. If their safety is in danger take action now. You can file to petition while you provide a safe environment for them. Do not solely rely on the U.S. immigration to speed up things. It will only add stress and grief.

I browse many immigration firms and have found that immigrate2us had many topics related to immigrants from Mexico and the ongoing danger with cartels.The forum isn't as busy as VJ but they may have more similar topics related to yours.

This...completely. I have a friend who was raped daily by knifepoint and she still had difficulty getting her asylum claim.

Practically impossible!!! I was in the same situation when i was going through my process, my wife and 2 children of ages 2 and 3 were in Michoacan

And basically there was nothing i can do even though i gave proof of children being kidnapped in the town where they were....................It was hard!

I agree with the other comments, move, lots of nice places in Mexico.

Seems odd that they would have left a 11 year old in that situation?
