I-134 notarized while in England?

Hi everyone,

Just wondering if anyone has any advice for me. I am the US citizen here in Leeds with my fiance until we get his visa and I am trying to do some things in advance so we are ready once we get the NOA2.

My parents are going to co-sponsor Rich since I have been travelling for a year and am not working. I am under the impression that I still need to fill out the I-134, even though I will basically be saying "I make no money and don't own property." Is this correct? Also, since I am here in Leeds, where would I go about getting it "sworn to or notice affirmed before a US consular or immigration officer"? Has anyone in the UK ever done this before? Sorry, I'm a bit lost! Thanks so much:)

Yes you do need to fill out an I-134 since you still are the primary sponsor, and petitioner. You can get it notarized at the Embassy or Consulate in the UK.

I suspect that it could be done that day, but to be on the safe side have it done a few days before, just visit the Embassy, and see American Citizen Services.

Have a look at this link - looks like it's a walk-in thing but that you can only go on certain days/at certain times... you'll probably need to go the day before (or whenever!) the interview, by the looks of things... even if the notary service was available all day every day, it would be a bit nerve-wracking to be stuck in the one queue in a panic because your interview time was looming - I'd guess there'll probably be a bit of queuing involved to get the form notarised rather than a straight in'n'out service! :)

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

Yes, that's what my wife and I are doing. Here's some advice I was given.

Vamos,

Do a search when you can on self sponsorship in London.

Whilst there is no hard and fast rules regarding the I-134, it is a totally different fish. For one there is no joint sponsorship ruling as there is for the I-864. All one needs to show is that the applicant wont become a public charge. This can be done in London with self sponsoring. Check with others from London for the specifics as the search function is malfunctioning so I am unable to link to the relevant information.

Not necessarily for a K visa. A K visa applicant may not need any sponsor at all, although most do. And when they do it need not be the petitioner.

As your wife will be your primary sponsor anyway, she is required to fill out the affidavit of support, whether or not she has a US income.

Sorry to say I believe you are misreading aussiewench's post.

"Self sponsorship" in London means the BENEFICIARY sponsoring themselves - the immigrant fiance or spouse showing proof of their own assets which they will be bringing to the US. In this case, the I-134 is filed by the immigrant and none is required of the petitioner.

There is anecdotal evidence at London of the so-called joint sponsor (the parents in this thread) filing the I-134 and no form being required by the petitioner.

The cautious route is to show up in London with an I34 filed by the petitioner and one by the joint sponsor.

I e-mailed the embassy last week and asked them if it would be ok for my wife to supply proof of savings without filling out an I-134 as she works in Scotland. They told me it would be fine and also reiterated the information the sponsor (my father-in-law) will have to supply. I'm not sure if this counts as a special arrangement but I found it more like a confirmation of the status quo.

I guess to be safe I will fill out the I-134, although it seems silly to have to get down to London to have them watch me sign a paper that says "I have no money, and no property." Oh well, better safe than sorry. I don't want any nasty surprises when my fiance goes for his interview.

Just thought I would post this email I got back from the embassy in London regarding the I-134. Turns out I don't need to fill it out if my parents are the main sponsors. Hopefully this helps those that are as confused as I was:) See below:

If your parents will file an I-134 on your fiancé's behalf then there is no reason why you should also complete an I-134 for your fiancé.

I am writing to get clarification regarding the document I-134. My fiance and I are currently in the process of applying for a K-1 Fiance visa and expect to be in London for an interview in the next few months. I am wondering if someone can clarify whether or not we need to submit an I-134.

I am a US citizen and have been travelling and visiting England for almost a year. Therefore, I am not employed in the US at this time so my parents are planning to be the sponsor for my fiance.
