Hello everyone, i found this process on how i can bring my 5years old daughter(born out of wedlock) to live with me in the US. My wife and I are USC and we decided to file I-130 for her. My daughter's biological mum is okay with it.


my question is: can I file I-129F immediately after filing I-130 which will make it quicker for her to join us here(according to what i saw on USCIS page). as anyone seen or gone through this process before?

Can my child come to the United States to live while the visa petition Is pending?


If you are a U.S. citizen, once you file Form I-130, your child is eligible to apply for a nonimmigrant K-4 visa. This will entitle him or her to come to the United States to live and work or go to school while the visa petition is pending. To petition for this benefit, you may file Form I-129F. However, you are not required to file Form I-129F and your child does not require a K-4 visa. Your child may wait abroad for immigrant visa processing. Seeking a K-4 visa can be a method for him or her to come to the United States more quickly. For more information, see the “K3-K4 Visa” page.

Takes about the same time, not even sure if it is available with no K3.

When did you become a US citizen? Your child may be elligible for citizenship, which would be the fastest way to get her here.

The K4 is not needed in this case; there is no waiting time for the minor child of a US citizen.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
