My husband got his 2 years green card through marriage with me. His green card will expire in April 2017. I just foun out that he has beeen cheating on me,. he told me that he never neede me. I has a girlfriend back home, and he moved out of the house to go live with another in my neighborhood in NY. i want to get a divorce, but i dont know how this should affect him when he applies for the 10 years green card.i want to know if it is best that i write the USCISwith the evidence that ca prove that he didnt come into the marriage with faithful intentions.

Sorry about your bad situation.

Nothing you can do about his immigration, he already has his 2 year conditional green card.

File for divorce and move on. You will still on the hook for the I-864 though.

He will be on his own for ROC (I-751).

Being faithful doesnt matter in terms of immigration. It's not marriage fraud. Divorce means he needs a waiver to file for ROC. So what you can do is divorce, cut your ties, and move on.

If I report the marriage to fraud will I get in trouble with immigration?

No.

However, do not expect USCIS to do much anything about the marriage fraud complaint.

They probably receive tons of letters like these from disgruntled USC.

Close whatever financial stuff you have jointly with him, and avoid any contact with him (in case he tries to set you up for DV case).

Write up a detailed report about your marriage fraud, include his A#, and drop it off with an FDNS officer at the local USCIS office, getting in on an INFOPASS appointment.


Talk with that FDNS officer, go over all, and IF the FDNS officer warrants there was fraud, then a record of this will get into his A-File.



When he applies for ROC, the A-File is reviewed. A finding of fraud from a FDNS officer trumps most stuff, his ROC case will be denied.

You will need solid proof of fraud for USCIS/ICE to actually do something about it, and even then it's far from a guarantee.

If it's just a "he said/she said" situation without any tangible evidence then you probably shouldn't waste your time, as your letter will go right in the circular drawer marked "T".

That said, if you have evidence, you should absolutely do it.

If you feel you've been used for a green card through marriage, you should report it. But do yourself a big favor and don't announce to him that you're going to do this. I know it's tempting, but don't do it.

Remove him from your bank account, separate your credit cards, get your financial ducks in a row and divorce and move on. Just cut him out of your life. Let him deal with ROC on his own.

Even with evidence clear cut evidence they do nothing. Divorce him and move on. I went through the same thing with my ex. I reported him every day and showed up at immigration with emails, letters, and conversations and they did not a single thing but pretty much told me there is nothing they can do. Mine was a K1 visa and he was out of status and they still did nothing. You can call DHS which I have done recently to let them know he is driving for uber and has been deemed inappropriate with children. They told me if I got his address they will send someone to talk to him because they take marriage fraud seriously. You can call them but I wouldn't bank on the fact they will do much.
